The Applicant apprehends arrest in Crime No.782 of 2025 registered with Shivajinagar Police Station, District: Kolhapur, for the offences punishable under Sections 80(2), 85, 108, 115(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short, "BNS Act"). 2.

It is the prosecution case is that the deceased, Maher Irfan Nizam Mujawar has committed suicide because of ill treatment given to her by the husband, mother-in-law (the Applicant), sister-in-law, and sister-in-law's husband. There was a demand of Rs.5,00,000/- from them. She was being physically and mentally ill treated for non fulfillment of the said demand.

Heard learned advocate for the Applicant and learned APP for the Respondent - State instructed by the Investigating Officer is present in the Court. Perused the investigation papers. 4.

Apart from the facts that, the Applicant/mother-in-law is residing separately from the deceased and her husband, the suicide note allegedly written by the deceased shows that the deceased has put entire blame on her sister-in-law - Sameena for abetting her suicide.

It prima facie appears that the Applicant had not played any role in abetting the suicide of the deceased. Applicant being a lady, is therefore, entitled for protection.

In the the result, the application is allowed in terms of interim protection granted vide order dated 24th December, 2025. 7.

Till filing of charge-sheet, Applicant shall attend the concerned police station as and when called by the Investigating Officer.

The Applicant shall not tamper the prosecution evidence. (NITIN B. SURYAWANSHI, J.)
