Applicant is apprehending his arrest in C.R. No. 387 of 2025 registered with Jaysingpur Police Station, District: Kolhapur for offences punishable under Sections 103(1), 189(2), 190, 191(2), 191(3) of Bhartiya Nyaya Sanhita, 2023.

2026.01.20 10:59:03 +0530 murdered by Akshay Mane, Sanket Hambar, Amin Rajput, Amit Sangavkar, Prathamesh @ Gotya Pawar in collusion with the present applicant for some unknown reason by smashing his head by stone. 3.

Heard learned advocate for the applicant, learned APP for the State instructed by the Investigating Officer. Perused the investigation papers.

The prosecution has relied upon statement of eye witness

which is recorded after almost two months on 14th December 2025. In the said statement, eye witness alleges that the applicant at the time of incident, assaulted the deceased with stick and accused Gotya Pawar smashed the head of the deceased with stone. Perusal of the post-mortem report, however, does not support the allegations made against the applicant as there are no injuries caused by stick on the body of the deceased.

The applicant has no criminal antecedents. The stick allegedly used in the present crime was recovered from the spot. The investigation is almost complete and charge-sheet is likely to be filed in the near future. The custodial interrogation of the applicant in the facts of the present case is therefore, not necessary. 6.

Hence, the application is allowed. In the event of arrest, the applicant Arvind Vishal Mali be released on bail in connection with C.R. No. 387 of 2025 registered with Jaysingpur Police Station, District: Kolhapur for offences punishable under Sections 103(1), 189(2), 190, 191(2), 191(3) of Bhartiya Nyaya Sanhita, 2023 on executing Personal Bond in the sum of Rs. 15,000/- with one surety in the like amount. The applicant shall not tamper the prosecution evidence.

The applicant shall attend the concerned police station as and when called by the Investigating Officer till filing of the charge-

sheet. The applicant shall not enter within the jurisdiction of Jayisngpur Police Station, District: Kolhapur till filing of the chargesheet. (NITIN B. SURYAWANSHI, J.)
