This is an application for anticipatory bail. 2.

The applicant is apprehending her arrest in Crime No. 1073 of 2022 registered at Kandivali Police Station, Mumbai for the offences punishable under Sections 406, 420, 465, 474 read with 34 of the Indian Penal Code.

It is the case of the prosecution, the present applicant and her husband, who is the co-accused in the present crime had sold the flat owned by them to the present applicant, which was allegedly mortgaged with the bank against the loan availed by them.

I have heard the learned counsel appearing for the applicant and the learned APP for the respondent / State. Dinesh S. Sherla 1/2

The learned counsel for the applicant submits that the applicant has nothing to do with the alleged crime. It is submitted that the main allegations are against the husband of the applicant. It is submitted that the prosecution has already filed the chargesheet and therefore there is no need of custodial interrogation. 6.

On the other hand, the learned APP for the respondent-State submits that considering the nature of crime, the applicant may not be released on anticipatory bail.

I have perused the charge-sheet. The main allegations are against the husband of the applicant. There are no other criminal antecedents against the applicant. In that view of the matter, I am inclined to release the applicant on anticipatory bail. In the result the following order is passed.

ORDER

A) The Application is allowed.

B) In the event of arrest of the applicant in C.R. No. 1073 of 2022 registered at Kandivali Police Station, Mumbai for the offences punishable under Sections 406, 420, 465, 474 read with 34 of the Indian Penal Code, she be released on bail on executing P.R. Bond in the sum of Rs.25,000/- with one surety or two sureties in the like amount. [N.R.BORKAR, J.] Dinesh S. Sherla 2/2
