This is an application for Anticipatory Bail. 2.
The applicant is apprehending his arrest in Crime No. 377 of 2025 registered at Kurar Village Police Station, for the offences punishable under Sections 137(2), 64(1), 64(2)(m) of the Bharatiya Nyaya Sanhita, 2023 and Sections 4, 8 & 12 of the Protection of Children from Sexual Offences Act, 2012. 3.
According to the prosecution, on the date of incident, which took place on 11.05.2025, the present applicant had kidnapped the victim and subjected her to physical relation. 1/3

I have heard the learned counsel for the applicant and the learned APP for the respondent-State and perused the statement of the victim.

The learned counsel for the applicant submits that the applicant and the victim were in love relationship. It is submitted that there is no need of custodial interrogation. It is submitted that the mother of the victim has filed affidavit that she has no objection if the present applicant is released on anticipatory bail. 6.
On the other hand, the learned APP for the respondentState submits that victim was 16 years old. It is submitted that considering the nature of crime the applicant may not be released on anticipatory bail.

I have perused the statement of the victim. The applicant and the victim were in love relationship. She on her own left her house. Considering the overall facts and circumstances of the case, I am inclined to release the applicant on anticipatory bail. In the result, the following order is passed :
O R D E R
a) The Application is allowed.

b) In the event of arrest of the applicant in connection with Crime No. 377 of 2025 registered at Kurar Village Police Station, for the offences punishable under Sections 137(2), 64(1), 64(2)(m) of the Bharatiya Nyaya Sanhita, 2023 and Sections 4, 8 & 12 of the Protection of Children from Sexual Offences Act, 2012, the applicant be released on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- with one or two sureties in the like amount.
c) The applicant shall not contact the victim.
