By this Anticipatory Bail Application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS"), the Applicant is seeking pre-arrest bail in connection with CR No.231 of 2025 registered with the Baramati Taluka Police Station, District-Pune, for the offences punishable under Sections 308(4), 118(2), 189(2), 189(4), 190, 191(3), 191(2), 351(2), 351(3), 352, 113(2) and 120(2) of the Bharatiya Nyaya Sanhita, 2023.

It is the contention of Mr. Paradkar, learned Counsel for the Applicant that the Applicant's only role is that he has assaulted the injured with a hockey stick. He submits that the injuries are simple in nature. Apart from that, he submits that the main allegations are against the Accused - Sahil alias Bhaiyya Londhe and he has been granted regular bail by this Court by Order dated 12th August 2025.

On the other hand, Mr. Mali, learned APP, strongly opposes granting anticipatory bail. He submits that the offence is very serious. The Applicant has actively participated in the crime and therefore the Anticipatory Bail Application be dismissed. Mr. Mali, learned APP, further states that although the Charge-sheet is filed, further investigation is going on.

Perusal of the record shows that there are allegations against Accused No.1 and Accused No.4. As far as the present Applicant who is Accused No.2 is concerned, the allegation is regarding the assault on the injured by a hockey stick. Charge-sheet has already been filed and therefore the investigation is complete. Accused No.4 - Pravin Bhapkar has been granted regular bail by Order
dated 16th July 2025 passed in Criminal Bail Application No.2771 of 2025 and Accused No.5 - Rehan Tamboli has been granted anticipatory bail by Order dated 25th August 2025 passed in Anticipatory Bail Application No.2331 of 2025. 6.
Accordingly, the case is made out for grant of anticipatory bail. In view thereof, the following Order is passed:
O R D E R
(a) In the event of arrest of the Applicant - Akshay Prabhakar Babar in connection with CR No.231 of 2025 registered with the Baramati Taluka Police Station, District-Pune, he be released on bail on his furnishing PR Bond in the sum of Rs.50,000/- with one or two solvent sureties in the like amount. (b) The Applicant shall attend the concerned Police Station on 29th October 2025, 30th October 2025 and 31st October 2025 between 11:00 am to 02:00 pm and thereafter once in a week i.e. on every Sunday, between 11:00 am to 02:00 pm and shall cooperate with the investigation.
(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.
(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
