This is an application for anticipatory bail. 2.
The applicants are apprehending their arrest in Crime No.301 of 2025 registered at Kashimira Police Station, for the offences punishable under Sections 143 (3) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Sections 3, 4, 5 & 8 of the Immoral Traffic (Prevention) Act.

The allegations against the present applicants and other coaccused are that they were running the brothel in Suryaprakash Lodge and Mantra Hotel.

I have heard the learned counsel appearing for the applicants and the learned APP for the respondent / State. 1/3

Learned counsel for the applicants submits that at the relevant time they were working as waiters in the said hotels. It is submitted that the applicants have nothing to do with the alleged crime. It is submitted that there is no need of custodial interrogation and the applicants are ready to cooperate in the investigation. It is submitted that there are no other criminal antecedents against the applicants.

On the other hand, learned APP for the respondent/State submits that the applicants used to contact the victims. It is submitted that considering the nature of crime, the applicants may not be released on anticipatory bail.

I have perused the statements of victims. The allegations that they were persuaded to engage in prostitution are against the co-accused. There appears to be no need of custodial interrogation. There are no other criminal antecedents against the applicants. Considering the overall facts and circumstances, I am inclined to release the applicants on anticipatory bail. In the result the following order is passed.
ORDER
A) The Application is allowed.
B) In the event of arrest of the applicants in C.R. No. 301 of 2025 registered at Kashimira Police Station, for the offences punishable under Sections 143 (3) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Sections 3, 4, 5 & 8 of the Immoral Traffic (Prevention) Act, they be released on bail 2/3
on executing P.R. Bond in the sum of Rs.25,000/- each with one surety or two sureties in the like amount. C) The applicants shall attend the concerned police station as and when called the Investigating Officer and and shall cooperate in the investigation.
