This is an application for Anticipatory Bail. 2.
The applicant is apprehending her arrest in Crime No. 648 of 2025 registered at Khar Police Station, Mumbai for the offences punishable under Sections 420 & 406 read with 34 of the Indian Penal Code.

It is the case of the prosecution that on 22.12.2022, the first informant had handed his BMW car to co-accused Natwar Raichura with understanding that he would find customer for rental. It is alleged that in April-2023 a car dealer informed him that his car was being offered for sale by co-accused Prajakt 1/3
Surve. It is alleged that on inquiry he found that one of the insurance companies had issued insurance policy in the name of the present applicant. He later on found that his car is in possession of the co-accused Rajiv Sone who refused to hand it over to him. It is alleged that the applicant and other co-accused tried to transfer the ownership of his car by preparing false documents.

I have heard the learned counsel for the applicant and the learned APP for the respondent-State.

The learned counsel for the applicant submits that the applicant is the housewife and has nothing to do with the alleged crime. It is submitted that the co-accused Prajakt Surve has sold the said car to the husband of the applicant. It is submitted that there is no need of custodial interrogation and the applicant is ready to co-operate in the investigation.

On the other hand, the learned APP for the respondentState submits that considering the nature of crime the applicant may not be released on anticipatory bail.

I have perused the first information report. The main 2/3
allegations are against the co-accused. There is no need of custodial interrogation. In that view of the matter, I am inclined to release the applicant on anticipatory bail. In the result, the following order is passed :
O R D E R
a) The Application is allowed.
b) In the event of arrest of the applicant in connection with Crime No. 648 of 2025 registered at Khar Police Station, Mumbai for the offences punishable under Sections 420 & 406 read with 34 of the Indian Penal Code. The applicant be released on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- with one or two sureties in the like amount.
c) The applicant shall attend the concerned police station as and when called by the investigating officer and shall co-operate in the investigation.
