This is an application for anticipatory bail. 2.

The applicant is apprehending his arrest in Crime No.899 of 2025 registered at Shanti Nagar Police Station, Thane for the offences punishable under Sections 333, 74, 115(2), 352 and 324

(4) of the Bharatiya Nayay Sanhita, 2023.

It is the case of the prosecution that the first informant and the present applicant were in a love relationship and as such they intended to get married. However, the parents of the first informant refused to marry her to the applicant as he was unemployed. This infuriated the applicant due to which on 28th July 2025, the applicant went to the first informant's aunt's house and assaulted the first informant with fist and kick blows so also outraged her modesty.

I have heard the learned counsel appearing for the applicant and the learned APP for the respondent / State. 5.

Learned counsel for the applicant submits that the applicant wanted to marry the victim as they were in love relationship, however, as the parents of the victim were against their marriage and thus the applicant came to be implicated in a false case. It is submitted that there is no need of custodial interrogation and the applicant is ready to cooperate in the investigation. 6.

On the other hand, learned APP for the respondent/State submits that considering the nature of crime, the applicant may not be released on anticipatory bail.

I have perused the FIR. The present applicant and the victim were in a love relationship. There appears to be no need of custodial interrogation. There are no other criminal antecedents against the applicant. Considering the said fact, I am inclined to release the applicant on anticipatory bail subject to certain conditions. In the result the following order is passed.

ORDER

A) The Application is allowed.

B) In the event of arrest of the applicant in C.R. No. 899 of 2025 registered at Shanti Nagar Police Station, Thane for the offences punishable under Sections 333, 74, 115(2), 352 and 324 (4) of the Bharatiya Nayay Sanhita, 2023, he be released on bail on executing P.R. Bond in the sum of 2/3

Rs.25,000/- with one surety or two sureties in the like amount.

C) The applicant shall attend the concerned police station as and when called by the Investigating Officer and shall cooperate in the investigation.

D) The applicant shall not enter into the limits of Bhiwandi Taluka and shall not contact the victim and/or her family members till conclusion of trial.
