This application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS") seeking pre-arrest bail in connection with C.R. No.567 of 2025 registered on 24th August 2025 with Satana Police Station, District Nashik (Rural) for the
offences punishable under Sections 118(1), 115(2), 351(2) and under Section 352 of the Bharatiya Nyaya Sanhita, 2023 ("BNS"). 3.
The learned Additional Sessions Judge, Malegaon District Nashik by order dated 09th September 2025 dismissed the Anticipatory Bail Application filed by the present Applicant being Criminal Bail Application No. 836 of 2025. The prosecution case is set out in Paragraph Nos.5, 6 and 7 of the said order, which reads as under :-
5. The informant is the injured. The incident took place on 23.08.2025 at about 6.00 p.m.in the premises of from village Bundhate. The informant and the applicant have previous enmity on account of agricultural land. They hails from village Dang-Saundane. Their lands are adjacent to each other. Earlier there were quarrels and prosecutions against each other on account of dispute of land are pending. On the day of incident, informant along with his cousin-Nikhil Khairnar were on motorcycle of his friend Prem Mohite in order to offer religious prayer in a temple.
6. The informant was returning to home that time his cousin Nikhil Khairnar was also with him. At about 6.00p.m., his motorcycle was in the premises of village Bundhate that time the applicant came on motorcycle No. MH 41 BD 2107. The applicant stopped his vehicle near to the motorcycle of the informant. The applicant started hurling abuses to the informant on account of earlier disputes of land. The applicant with the help of sharp knife-koyta hit to informant on his back. The informant shouted as such his cousin rushed towards him. The applicant fled away from the spot. His cousin
hospitalized him to primary health center at DangSaundane then to rural hospital Saundane.
7. On that count, the informant lodged the report at police station Satana on 24.08.2025. The police station officer Satana registered crime No. 567/2025 for the offence punishable under Section 118(1), 115(2), 351(2), 352 of the Bhartiya Nyaya Sanhita, 2023 against present applicant /accused.

It is the submission of Mr. Babita Pandey, learned Counsel appearing for the Applicant that as there is land dispute between the family of the Applicant and family of the First Informant several cases are lodged against each other. She submits that false FIR has been lodged.

On the other hand, Ms. Gajare, learned APP submits that the offence is very serious where the Applicant has used 'Koyata' and assaulted the First Informant on his back. She further submits that there are antecedents therefore, the Anticipatory Bail Application be rejected.

Perusal of the record shows that there is land dispute between the family of the Applicant and the family of the First Informant and in view of the said land dispute multiple FIRs have been filed by the family members of the Applicant and First
Informant against each other. Although, there are antecedents, the same are lodged due to said land dispute. In the facts and circumstances custodial interrogation is not necessary. 7.
Accordingly, the case is made out for grant of Anticipatory Bail. In view thereof, the following order is passed:
O R D E R
(a) In the event of arrest of the Applicant- Hemant Shashikant Chandradatre in connection with C.R. No.567 of 2025 registered with the Satana Police Station, District Nashik (Rural) the Applicant is directed to be released on bail on his furnishing P.R. Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount.
(b) The Applicant shall attend the Satana Police Station, Nashik on 04th December 2025 and 05th December 2025 between 11:00 a.m. to 02:00 p.m. and thereafter the Applicant shall attend the Satana Police Station, Nashik on every 1st Sunday and 3rd Sunday of each month between 11:00 a.m. to 02:00 p.m. till filing of
the chargesheet.
(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.
(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
