This is an Application for anticipatory bail. MUGDHA MANOJ PARANJAPE 2.

The Applicant is apprehending her arrest in Crime No. 262 of 2025 registered with Samta Nagar Police Station for the offences punishable under Section 303 (2) of the Bharatiya Nyaya Sanhita, 2023. 3.

The first informant is the mother-in-law of the Applicant. Due to matrimonial dispute, on 15th November 2024, the Applicant left the house at around 7.00 p.m. and while leaving the house, it is alleged that the Applicant had taken away gold ornaments and other valuables from the cupboard belonging to the first informant worth Rs.1,31,200/-. Hence, the FIR was lodged.

I have heard Learned Counsel for the Applicant and Learned APP for the Respondent-State.

Learned Counsel for the Applicant submits that due to matrimonial Mugdha

2 920-ABA 2637-25.doc dispute, false FIR came to be lodged against the Applicant. It is submitted that the Applicant is ready and willing to cooperate in the investigation. 6.

On the other hand, Learned APP for the Respondent-State submits that custodial interrogation of the Applicant is necessary to recover the gold ornaments. He thus submits that the Applicant may not be released on anticipatory bail.

I have perused the FIR. Considering the fact that there is a matrimonial dispute between the parties, I am inclined to release the Applicant on anticipatory bail. Hence, the following order:

ORDER

i.

The Anticipatory Bail Application is allowed. ii.

In the event of the arrest of the Applicant in Crime No. 262 of 2025 registered with Samta Nagar Police Station for the offences punishable under Section 303 (2) of the Bharatiya Nyaya Sanhita, 2023, she shall be released on bail on furnishing a PR Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one or two sureties in the like amount.

iii. The Applicant shall attend the concerned Police Station as and when called for by the investigating officer and shall cooperate in the investigation. 8.

The present Anticipatory Bail Application is disposed of in the aforesaid terms.
