This is an Application for anticipatory bail. 2.

The Applicant is apprehending his arrest in Crime No.33 of 2025 registered with Manor Police Station for the offences punishable under Sections 105, 238, 3(5) of the Bharatiya Nyaya Sanhita, 2023 and 3, 25 of the Arms Act, 1959.

The case of the prosecution is that on the date of incident, which took place on 28th January 2025, one of the co-accused mistakenly fired a gun shot at the first informant's father, thereby causing his death. The allegation against the present Applicant is that the gun which was carried by the co-accused at the relevant time belonged to the present Applicant. 4.

Heard Learned Counsel for the Applicant and Learned APP for the Respondent-State.

Admittedly the Applicant was not present at the place of incident. The prosecution has already filed chargesheet against the other coaccused. The gun is already recovered. There are no criminal antecedents against the Applicant. In that view of the matter, I am inclined to release the Applicant on anticipatory bail. Hence, the following order:-

ORDER

i.

The Anticipatory Bail Application is allowed. ii.

In the event of the arrest of the Applicant in Crime No.33 of 2025 registered with Manor Police Station for the offences punishable under Sections 105, 238, 3(5) of the Bharatiya Nyaya Sanhita, 2023 and 3, 25 of the Arms Act, 1959, he shall be released on bail on furnishing a PR Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one or two sureties in the like amount.

The present Anticipatory Bail Application is disposed of in the aforesaid terms.
