This is an Application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS") seeking prearrest bail in connection with CR No.58 of 2025 registered with the Baramati City Police Station, Pune Rural, for the offence punishable under Sections 189(2), 191(2), 190, 115(2), 117(2), 119(1), 74 and 352 of the Bharatiya Nyaya Sanhita, 2023 ("BNS").

As per the prosecution case, the Informant i.e. injured and the victim-lady were travelling in a car at about 11:00 pm and at that time the Informant received a phone call from his friendAnsar Khan who informed him that while reversing his vehicle, there was dash to another vehicle and therefore said Ansar Khan requested the First Informant to come to the spot. The First Informant went to the said spot, and since some damage was caused to the vehicle, said Ansar Khan expressed his willingness to pay compensation. However, 5-6 boys arrived on motorcycles and started questioning said Ansar Khan. At that time, the First Informant intervened, and thereafter, all 5-6 boys started assaulting the First Informant with fists and kick blows on his face, chest and abdomen, resulting into an injury to his left eye and blood started oozing therefrom. At that time, when the victim-lady tried to intervene, one Accused attempted to touch her inappropriately and also give filthy abuses.

It is the submission of Mr. Zade, learned Counsel for the Applicant that the Applicant is not involved in the crime.

However, Ms. Yadav, learned APP, states that the Applicant is involved in the crime. She submits that the Applicant touched the victim-lady. She Submits that there are 12 antecedents against the Applicant. Learned APP, states that there are a total of six Accused. Four Accused have been arrested and released on regular bail. The Applicant is the main Accused and he is absconding. The Applicant has assaulted the Complainant, causing an injury on his eye and also took Rs.6,000/- from the Complainant's pocket. 6.
Mr. Zade, learned Counsel, states that details about the antecedents are mentioned in the Application. There are a total of 12 antecedents. Out of the 12 antecedents, the Applicant has been acquitted in 8 cases and as far as 4 antecedents are concerned, those cases are pending in the Court.

Perusal of the record shows that the Applicant is involved in a very serious offence. The offence alleged against the Applicant is voluntarily causing hurt or grievous hurt to extort property. Section 74 of BNS has also been invoked for outraging the modesty of the victim-lady accompanying the Complainant.
The allegations as far as Section 74 of BNS are concerned, the same are against the Applicant. There are total 12 antecedents. 8.
Accordingly, in the facts and circumstances, no case is made out for grant of Anticipatory Bail Application. 9.
