This is an Application for anticipatory bail. 2.

The Applicant is apprehending his arrest in Crime No.632 of 2025, registered with Sakinaka Police Station for the offences punishable under Sections 3, 4 and 5 of the Immoral Traffic (Prevention) Act, 1956 and 144(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3.

It is the case of the prosecution that on 28th June 2025, secret information was received regarding illegal prostitution activities being carried out under the guise of massage services at Solistic Sky Spa & Spa, Sakinaka. Accordingly, a trap was laid and raid was conducted along with two panch witnesses. Upon conducting the raid, it was disclosed that three women were compelled to engage into prostitution activities, upon the instructions of the manager and owner of the said premises.

The allegations against the present Applicant are that he is the owner of Solistic Sky Spa and Spa at Sakinaka, Mumbai. 5.

I have heard Learned Counsel for the Applicant and Learned APP for the Respondent-State.

Learned Counsel for the Applicant submits that the Applicant has nothing to do with the alleged crime. It is submitted that the present Applicant became partner in the said Spa on 18th March 2025. It is submitted that there are no other criminal antecedents against the Applicant. It is further submitted that there is no need of custodial interrogation and the Applicant is ready and willing to cooperate in the investigation.

On the other hand, Learned APP for the Respondent-State submits that the Manager of the Spa, who is a co-accused in the present crime, has disclosed the involvement of the present Applicant in the crime in question. It is submitted that one of the victims has stated about the present Applicant.

I have perused the statement of the said victim. She does not state that the present Applicant has persuaded her to engage in the prostitution activity. The incriminating WhatsApp chats are between the Manager and the said victim. Considering the overall facts and circumstances of the case, I am inclined to release the Applicant on Anticipatory Bail. Hence, the following order:

ORDER

i.

The Anticipatory Bail Application is allowed. ii.

In the event of the arrest of the Applicant in Crime No.632 of 2025, registered with Sakinaka Police Station for the offences punishable under Sections 3, 4 and 5 of the Immoral Traffic (Prevention) Act, 1956 and 144(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, he shall be released on bail on furnishing a PR Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one or two sureties in the like amount.

iii. The Applicant shall attend the concerned Police Station as and when called for by the investigating officer and shall cooperate in the investigation. 9.

The present Anticipatory Bail Application is disposed of in the aforesaid terms.
