This is an application for Anticipatory Bail. 2.

The applicant is apprehending his arrest in Crime No. 348 of 2025 registered at Mira Road Police Station, for the offences punishable under Sections 143(3) & 3(5) of the Bharatiya Nyaya Sanhita, 2023, read with Sections 3, 4, 5 & 7 of the Immoral Traffic (Prevention) Act, 1956 and read with Sections 17 & 18 of the Protection of Children from Sexual Offences Act, 2012. 3.

It is the case of the prosecution that on 23.07.2025, on the basis of secret information, a raid was conducted at Royal King 1/4

Thai Spa and it was found that the present applicant and other coaccused were running prostitution activities therein. According to the prosecution, one of the victims was minor. 4.

I have heard the learned counsel for the applicant and learned APP for the respondent-State.

The learned counsel for the applicant submits that according to the prosecution the present applicant is the owner of the Spa in question. It is submitted that the leave and licence agreement is in the name of the brother of the present applicant. It is further submitted that there is nothing to show that present applicant compelled the victims to engage in prostitution activity. The learned counsel submits that the investigation is over and the prosecution has already filed the charge-sheet against the other co-accused.

On the other hand, the learned APP for the respondentState submits that the present applicant to conceal his identity has used fake name as Ranvir. It is submitted that the present applicant is the owner of the Spa in question. It is submitted that 2/4

considering the nature of crime the applicant may not be released on anticipatory bail.

I have perused the charge-sheet. There is nothing to show that the present applicant was running the Spa in question or that he compelled the victims to engage in prostitution activity. In that view of the matter, I am inclined to release the applicant on anticipatory bail. In the result, the following order is passed :

O R D E R

a) The Application is allowed.

b) In the event of arrest of the applicant in connection with Crime No. 348 of 2025 registered at Mira Road Police Station, for the offences punishable under Sections 143(3) & 3(5) of the Bharatiya Nyaya Sanhita, 2023, read with Sections 3, 4, 5 & 7 of the Immoral Traffic (Prevention) Act, 1956 and read with Sections 17 & 18 of the Protection of Children from Sexual Offences Act, 2012, the applicant be released on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- with one or two sureties in the like amount.

c) The applicant shall attend the concerned police station as and when called by the investigating officer and shall co-operate in further investigation, if any.
