This application is filed under Section 482 of the Bharatiya Nyaya Suraksha Sanhita, 2023 seeking pre-arrest bail in connection with C.R. No.155 of 2025 registered with Bavdhan Police Station, Pune, for the offences punishable under Sections

109, 117(2), 352, 351(2) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023.

Mr. Nimbalkar, learned Counsel appearing for the Applicant states that there is no role attributed to the present Applicant and that the other co-accused have been granted regular bail. He submits that even the chargesheet is also filed against the other accused. He therefore, submits that thus, the investigation is completed.

Ms. Yadav, learned APP, strongly opposes the Anticipatory Bail Application.

The prosecution case is set out in paragraph 2 of the order dated 8th September 2025 passed by the learned Additional Sessions Judge, Pune, in Bail Application No.5381 of 2025, which is as follows:

"2. It is allegation in the FIR that on 17/04/2025 at about 7:30 pm Shubham Bankar and his friend Ganesh Pakhare had come to the workshop of informant Sarfaraj Masjid Ansari with spare parts of four wheeler and on account of suggesting Shubham and Ganesh to move aside as informant

was facing difficulty to pick up the punching ball which was lying near Shubham Bankar and Ganesh Pakhare, Ganesh became angry and they both assaulted, abused informant and his friend Sabrealam Beg who had come to rescue the quarrel. Thereafter, at about 8:30 pm again Shubham and Ganesh came to the workshop along with their two companions and assaulted Sabrealam Beg by wooden stump and wooden strip on his head due to which he was severely injured and became unconscious. Therefore, this report is filed against Ganesh Parkhe, Shubham Bankar and other two accused."

Although prima facie, the present Applicant has participated in the crime, however, chargesheet is already filed against other accused. Thus, the investigation is substantially completed. The Applicant has no antecedents.

Accordingly, the case is made out for grant of Anticipatory Bail. In view thereof, the following order is passed:

O R D E R

(a) In the event of arrest of the Applicant-Shubham Ravindra Bankar in connection with C.R. No.155 of 2025 registered with the Bavdhan Police Station, Pune, the Applicant is directed to be released on bail on his furnishing P.R. Bond in the sum of Rs.15,000/-

with one or two solvent sureties in the like amount. (b) The Applicant shall attend the Bavdhan Police Station on 13th October 2025, 14th October 2025 and 15th October 2025 between 11:00 a.m. to 02:00 p.m. Thereafter, the Applicant shall attend the concerned Police Station once in 15 days i.e. on 1st and 3rd Sunday between 11:00 a.m. to 01:00 p.m. and as and when called by the Investigating Officer till filing of the chargesheet and shall cooperate with the investigation.

(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(e) The Applicant shall not tamper with the prosecution

evidence and shall not contact or influence the Complainant or any witness in any manner.

(f) The Applicant shall not leave India without prior permission of the Court.
