Heard Mr. Gaware Patil, learned Counsel appearing for the Applicant and Ms. Mulekar, learned APP appearing for the Respondent-State.

This application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking pre-arrest bail in connection with C.R. No.505 of 2025 registered with Shirur Police Station, Pune Rural, Pune, for the offences punishable under Sections 108 of the Bharatiya Nyay Sanhita, 2023.

It is the prosecution case that the deceased-Sanket, the son of the First Informant was working at Samarth Optics owned by the Applicant. It is alleged that the Applicant abated suicide of the deceased-Sanket. Deceased-Sanket died by suicide on 27th June 2025 and the FIR was lodged on 15th July 2025. 4.

It is the submission of Mr. Gaware Patil, learned Counsel appearing for the Applicant that the incident in question has taken place on 27th June 2025 and the FIR has been lodged on 15th July 2025. He submits that the Applicant is not involved in the crime and in any case, the Applicant has cooperated with the investigation. There are no antecedents against the Applicant. 5.

On the other hand, Ms. Mulekar, learned APP opposes the Anticipatory Bail Application. She submits that the Applicant is involved in the crime. On instructions, she submits that the investigation is completed and the chargesheet will be filed very soon. On instructions, she further submists that there are no antecedents against the Applicant.

Perusal of the record shows that the incident in question took place on 27th June 2025 and the FIR has been lodged on 15th July 2025. The Applicant has cooperated with the investigation. The investigation is almost completed.

Accordingly, the case is made out for grant of Anticipatory Bail. In view thereof, the following order is passed:

O R D E R

(a) In the event of arrest of the Applicant-Rajendra in connection with C.R. No.505 of 2025 registered with the Shirur Police Station, Pune Rural, Pune, the Applicant is directed to be released on bail on his furnishing P.R. Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount. (b) The Applicant shall attend the Shirur Police Station, Pune Rural, Pune as and when called.

(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
