Heard Mr. Mooman, learned Counsel appearing for the Applicants, Ms. Yadav, learned APP, Mr. Metkari, learned APP and Ms. Gajre, learned APP, for the Respondent-State of Maharashtra. 2.
By these Anticipatory Bail Applications filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS"), the Applicants are seeking pre-arrest bail in connection with CR No.113 of 2025 registered on 20th March 2025 with the Upnagar Police Station, Nashik City, for the offences punishable under Sections 103, 351(3), 352, 189(2), 190 and 191(2) of the Bharatiya Nyaya Sanhita, 2023.

The Applicant - Arjun Tukaram Ranshur in Anticipatory Bail Application No.2769 of 2025 is Accused No.15, the Applicant - Pooja Yogesh Rakade alias Pooja Rangnath Bhalerao in Anticipatory Bail Application No.2774 of 2025 is Accused No.14 and the Applicant - Roshni Vishwas Donde in Anticipatory Bail Application No.2779 of 2025 is Accused No.11 in said CR No.113 of 2025.

It is the main contention of Mr. Mooman, learned Counsel appearing for the Applicants, that the only allegation, even as per the prosecution case, against the respective Applicants is that they have destroyed evidence. He submits that, therefore, the offence alleged against the present Applicants falls under Section 238 of the BNS, which is a bailable offence. He further submits that the Applicants will completely cooperate with the investigation. 5.
On the other hand, Ms. Yadav, learned APP, Mr. Metkari, learned APP and Ms. Gajre, learned APP, strongly oppose the Anticipatory Bail Applications. They submit that, in fact, it was the duty of the Applicants to inform the Police immediately, and therefore, the Anticipatory Bail Applications be dismissed. 6.
Perusal of the record shows that the only allegation against the present Applicants is causing the disappearance of evidence which constitutes an offence under Section 238 of the BNS. The said offence is bailable.

Mr. Mooman, learned Counsel for the Applicants, states that the Applicants will completely cooperate with the investigation.

Accordingly, the case is made out for grant of anticipatory bail. In view thereof, the following Order is passed:
O R D E R
(a) In the event of arrest of the Applicant - Arjun Tukaram Ranshur, Applicant - Pooja Yogesh Rakade alias Pooja Rangnath Bhalerao and Applicant - Roshni Vishwas Donde, in connection with CR No.113 of 2025 registered with the Upnagar Police Station, Nashik City, they be released on bail on their furnishing PR Bond in the sum of Rs.15,000/- each with one or two solvent sureties each in the like amount.
(b) The Applicants shall attend the concerned Police Station on 13th November 2025, 14th November 2025 and 15th November 2025 between 11:00 am to 02:00 pm and thereafter as and when called by the Investigating Officer and shall cooperate with the investigation.
(c) The Applicants shall furnish their cell phone numbers and residential addresses to the Investigating Officer and shall keep the same updated, in case of any
change thereto.
(d) The Applicants shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(e) The Applicants shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
(f) The Applicants shall not leave India without prior permission of the Court.

The Anticipatory Bail Applications are disposed of accordingly.
