Heard Mr. Pawar, learned Counsel appearing for the Applicant and Mr. Karmakar, learned APP for the Respondent-State of Maharashtra.

By this Anticipatory Bail Application, the Applicant is seeking pre-arrest bail in connection with CR No.327 of 2025 registered with the Khadak Police Station, Pune City, for the offences punishable under Section 12(a) of the Maharashtra Prevention of Gambling Act, 1887 and Sections 112 of the Bharatiya Nyaya Sanhita, 2023.

As per the prosecution case, on 26th June 2025 at about 02:00 p.m., Accused - Vyankatesh Timanna Kaveri found accepting amount through mobile for booking numbers to play online gambling. During investigation the role of the present Applicant is disclosed. There are a total of 36 Accused persons in the alleged offence. As far as the present Applicant is concerned, the role alleged is that he was participating in gambling. The main allegations are against the Accused No.1.

Mr. Pawar, learned Counsel for the Applicant submits that the Applicant will cooperate with the investigation. 5.
Accordingly, the case is made out for grant of anticipatory bail. In view thereof, the following Order is passed:
O R D E R
(a) In the event of arrest of the Applicant - Sanjay Bhabutmal Mutha in connection with CR No.327 of 2025 registered with the Khadak Police Station, Pune City, he be released on bail on his furnishing PR Bond in the sum of Rs.20,000/- with one or two solvent sureties in the like amount.
(b) The Applicant shall attend the concerned Police Station as and when called by the Investigating Officer till filing of the Charge-sheet and shall cooperate with the investigation.
(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.
(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
(f) The Applicant shall not leave India without prior permission of the Court.
