By this Anticipatory Bail Application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS"), the Applicant is seeking pre-arrest bail in connection with CR No.72 of 2025 registered with the Deolali Camp Police Station, Nashik City, for the offences punishable under Sections 109, 118(2), 115(2), 352, 351(2), 189(2), 191(2), 191(3), 324(4) and 190 of the Bharatiya Nyaya Sanhita, 2023.

It is the contention of Mr. Dighe, learned Counsel for the Applicant that even if the entire FIR is read as it is, then also it is clear that the Applicant has no role to play. In fact, the Applicant has tried to prevent the assault.

Ms. Yadav, learned APP for the Respondent-State of Maharashtra strongly opposes granting anticipatory bail. She submits that the Applicant has one antecedent. 5.
The role attributed to the Applicant was that he was present when the incident took place. There are no criminal antecedents against the Applicant except CR No.113 of 2019 registered at Deolali Camp Police Station, Nashik City, for the offence punishable under Sections 324, 323, 504 and 506 of the Indian Penal Code, 1860.

Accordingly, the case is made out for grant of anticipatory bail. In view thereof, the following Order is passed:
O R D E R
(a) In the event of arrest of the Applicant - Sahil Pravin Gaikwad in connection with CR No.72 of 2025
registered with the Deolali Camp Police Station, Nashik City, he be released on bail on his furnishing PR Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount.
(b) The Applicant shall attend the concerned Police Station as and when called by the Investigating Officer till filing of the Charge-sheet and shall cooperate with the investigation.
(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.
(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(e) The Applicants shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
(f) The Applicant shall not leave India without prior permission of the Court.
