Heard Mr. Kamath, learned Counsel appearing for the Applicant and Ms. Newton, learned APP for the State. 2.

By this application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS"), the Applicant is seeking pre-arrest bail in connection with C.R. No.257 of 2019 registered with Kamshet-Takve Police Station, Pune Rural, for the offences punishable under Sections 416, 420, 467, 468, 471 read with Section 34 of the Bharatiya Nyaya Sanhita, 2023 ("BNS").

It is the submission of the learned Counsel for the Applicant that the Applicant is not involved in the crime and he was merely present when the incident took place.

On the other hand, Ms. Newton, learned APP strongly opposes the Application. She submits that the offence is very serious and therefore Anticipatory Bail be not granted to the Applicant.

The prosecution case is set out in paragraph No.2 of the Order dated 6th August 2025 2026 passed by the learned Additional Sessions Judge, Vadgaon Maval, District-Pune in Criminal Bail Application No. 173 of 2025, which reads as under : "2.

The offence punishable under Section 420, 467 468, 471 read with Section 34 of Indian Penal Code is registered against applicant accused and other accused at Kamshet Police Station under Crime No. 257/2019. It is alleged in the report filed by the complainant Pratapchand Bhabutmalji Marwadi Jain that he is legal heir of his cousin grand father Champalal Chhaganlal Marwadi along-with other heirs. They have obtained heirship certificate. The landed property situated at village Khadkale, Kamshet, Gat No.66/A, area H.1.32, 0.6R was owned by his grandfather. The application to record the names of legal heirs in accordance with heirship certificate is given by him towards revenue authority. When he gave such application he learned that forged registered sale deed in respect of said landed property is executed on 10.05.2019 by personating fake person in place of Champalal Chhaganlal Marwadi pretending that the said person is Champalal Chhaganlal

Marwadi. The complainant immediately collected certified copy of sale deed in question. He further realized that false document of PAN Card No. CSVPM1849L was prepared. The land in question is sold to one Nagesh Vinayak Soparkar who is accused No.1 in this case. Whereas Rohan Haribhau Naik, Vaijnath Umakant Birajdar have put their signature on said forged document of sale deed as witness, whereas Sallu Imtiyaz Khan has put his signature thereon as identifier. The complainant learned that all the aforesaid persons, in collusion of each other and other unknown person, have brought in to existence the said forged document. According to the complainant, the valuation of said property in accordance with the ready recknor is 4.66 Crore, however, the consideration price is shown just Rs. 80,00,000/-.

The complainant further alleged in his report that said Champalal Chhaganlal Marwadi Jain was not alive on the date of execution of deed as he died long back on 13.12.1992 leaving behind the complainant and others as legal heirs. The offence to that effect is registered initially against Nagesh Vinayak Soparkar, Rohan Haribhau Naik, Vaijnath Umakant Birajdar, Sallu Imtiyaj Khan and other unknown person." 6.

The Charge-sheet has already been filed. All other coAccused were arrested and granted regular bail. There are no antecedents against the Applicant.

Accordingly, case is made out for grant of anticipatory bail. Hence, following Order is passed:

O R D E R

(i) In the event of arrest, the Applicant - Amol Balaram Pashte be released on bail in C.R. No.257 of 2019

registered with Kamshet-Takve Police Station, Pune Rural, on executing P.R. bond of Rs.50,000/- and furnishing one or two solvent sureties in the like amount.

(ii) The Applicant shall attend the concerned Police Station as and when required by the Investigating Officer and shall co-operate with the investigation. (iii) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(iv) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(v) The Applicant shall not leave India without prior permission of the Court.

(vi) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant, or any witness, in any manner.

The Anticipatory Bail Application is allowed and disposed of accordingly.
