Heard Mr. Siddharth Jagushte, learned Counsel appearing for the Applicant and Mr. Mali, learned APP for the State. 2.
By this application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS"), the Applicant is seeking pre-arrest bail in connection with C.R. No.232 of 2025 registered with Khadak Police Station, Pune City, for the offences punishable under Sections 112, 303(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 ("BNS").

The case of the prosecution is that on 19th January 2025 between 4.00 p.m. to 6.00 p.m., the Informant Gautam Jayantilal
Solanki had hired a worker namely Netaji Jadhav to take the heavy locker from his house situated at Shukrawar Peth to Avanti Building, Tilak road, Pune. At that time, the accused had stolen 20 gold biscuits weighing 100 grams each, kept in the locker. Therefore, the First Informant lodged report with Khadak Police Station. On the basis of his report, CR no. 232/2025 came to be registered. The same is lodged against Accused-Netaji Arun Jadhav. 4.
It is the submission of Mr. Siddharth Jagushte, learned Counsel for the Applicant that the Applicant is not involved in the crime and in fact, the F.I.R. is also not lodged against him. The offence is registered against said Netaji Jadhav and during investigation, the role of his two sons namely Pravin Jadhav and Onkar Jadhav was disclosed. Learned Counsel submits that they have been already granted protection by ad-interim Order dated 14th July 2025 passed by a learned Single Judge (R.N. Laddha J.) in Anticipatory Bail Application No. 1901 of 2025. Learned Counsel submits that the only allegation against the Applicant is that, he is not co-operating with the investigation. He states that the said allegation is not correct and that the Applicant has co-
operated with the investigation. He states that the Applicant will attend the Police Station and co-operate with the investigation. 5.
Accordingly, the Applicant is entitled to pre-arrest bail. Hence, following Order is passed:
O R D E R
(i) In the event of arrest, the Applicant - Sampat Babaso Jadhav be released on bail in C.R. No.232 of 2025 registered with Khadak Police Station, Pune City, on executing P.R. bond of Rs.25,000/- and furnishing one or two sureties in the like amount.
(ii) The Applicant shall attend the concerned Police Station on 30th October 2025, 31st October 2025 and 1st November 2025 between 11.00 a.m. to 2.00 p.m. and thereafter as and when called by the Police and shall co-operate with the investigation.
(iii) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and
shall keep the same updated, in case of any change thereto.
(iv) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(v) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant, or any witness, in any manner.

The Anticipatory Bail Application is allowed and disposed of accordingly.
