By this application filed under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023, the Applicant is seeking PreArrest Bail in connection with CR No.499 of 2021 dated 27/12/2021 registered with Walchandnagar Police Station, Pune, for offences punishable under Sections 395, 397 and 412 of the Indian Penal Code,1860 ("IPC").

As per the prosecution case on 27/12/2021, First Informant
lodged Report stating that when she was sleeping at her house with her family members, four unknown persons came with weapons and threatened them and took away the gold jewelry and committed robbery. The role alleged against this applicant during investigation is that the applicant has purchased the stolen property namely gold ornaments.

It is the main submission of the learned Counsel appearing for the Applicant that on the very day i.e. on 27/12/2021, two FIRs were filed for offences under the same Sections namely CR No. 499/2021 i.e. the subject FIR and CR No. 500/2021. He submitted that on 16/01/2023, the Applicant was arrested in CR No.500/2021 and he has been released after a period of 22 days i.e. on 08/02/2023. He submits that although the Applicant was available to the Walchandnagar Police for a period of 22 days, he was not arrested in the present case. He submits that the Applicant has completely co-operated with the investigation. He further submits that although, there are two Antecedents, the Applicant has been released on bail in the said antecedents. He submits that the Applicant has been released on regular bail in CR No.500 of 2021 and as far as CR No. 82 of 2022, the Supreme Court has granted interim protection. Learned Counsel therefore, submits
that the anticipatory bail be granted.

Learned APP, on instructions, submits that the Applicant has not co-operated with the investigation and offence is very serious. 6.
In the facts and circumstances and considering the role of the Applicant in the crime, the case is made out for grant of anticipatory bail. In view thereof, the following Order is passed:
O R D E R
(a) In the event of arrest of the Applicant- Santosh Vinayak Pandit in connection with CR No.499 of 2021 registered with the Walchandnagar Police Station, Pune, the Applicant is directed to be released on bail on his furnishing PR Bond in the sum of Rs.1,00,000/- with one or two solvent sureties in the like amount. (b) The Applicant shall attend the concerned Police Station on 15th October 2025 and 16th October 2025 and between 11:00 am to 02:00 pm and thereafter the Applicant shall attend the concerned Police Station once in a week i.e. on 1st Sunday of every month between 11:00 am to 02:00 pm and also as and when called by the Investigating Officer till filing of the
Charge-sheet and shall cooperate with the investigation.
(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.
(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
(f) The Applicant shall not leave India without prior permission of the Court.
