These applications are filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 by the Applicant/Accused No.1-Dipak Bhagavan Shelake (Anticipatory Bail Application No.2842 of 2025) and the Applicant/Accused No.2-Chandrashekhar Vasant Ingawle (Anticipatory Bail Application No.2754 of 2025) seeking pre-arrest bail in connection with C.R. No.215 of 2025 registered with Bundgarden Police Station, Pune, for the offences punishable under Sections 117(2), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

As per the prosecution case, there are some business transactions between Geetanjali Salunkhe and the Applicants. The incident in question took place on 8th July 2025 when the First Informant-Nikhil Karnavat, Geetanjali Salunkhe and one Umesh Savale visited the office of the Applicants for discussing balance payment of Rs.7,00,000/- to be made by said Geetanjali Salunkhe. During the said discussion, the dispute started between these persons and the same has escalated and thereafter, the Applicants have assaulted the First Informant-Nikhil Karnavat, Geetanjali Salunkhe and Umesh Savale. The injuries are grievous in nature. 4.
It is the submission of Mr. Avachat, learned Counsel appearing for the Applicant in Anticipatory Bail Application No.2842 of 2025 and Mr. Joshi, learned Counsel appearing for the Applicant in Anticipatory Bail Application No.2754 of 2025 that the incident in question took place on a spur of moment. There was no intention to commit the crime. Both of them submit that the chargesheet is already filed on 6th October 2025 and therefore, the investigation is completed. There are no antecedents against the Applicants. Both of them therefore, submit that the Applicants be granted pre-arrest bail.

On the other hand, Ms. Yadav, learned APP appearing for the Respondent No.1-State and Mr. Bhagwat, learned Counsel appearing for the Applicant/Intervenor strongly opposed the Anticipatory Bail Applications. Both of them submit that the offence is very serious and injuries are grievous in nature. 6.
Perusal of the record shows that there are some business transactions between the Applicants and Geetanjali Salunkhe. Rs.7,00,000/- were outstanding which were to be paid by Geetanjali Salunkhe to the Applicants. It appears that for discussing the said business transactions, said Geetanjali Salunkhe along with First Informant - Nikhil Karnavat and Umesh Savale went to the office of the Applicants and while discussing the said business transactions, the dispute started and thereafter the Applicants abused and assaulted the victims. It is true that the injuries are grievous, however, prima facie the incident in question took place on a spur of moment. The investigation is completed and the chargesheet is already filed. There are no other antecedents against the Applicants.

Accordingly, the case is made out for grant of Anticipatory Bail. In view thereof, the following order is passed:
O R D E R
(a) In the event of arrest of the Applicant-Dipak Bhagavan Shelake in Anticipatory Bail Application No.2842 of 2025 and the Applicant-Chandrashekhar Vasant Ingawle in Anticipatory Bail Application No.2754 of 2025 in connection with C.R. No.215 of 2025 registered with the Bundgarden Police Station, Pune the Applicants are directed to be released on bail on their furnishing P.R. Bond in the sum of Rs.25,000/- each with one or two solvent sureties each in the like amount.
(b) The Applicants shall attend the Bundgarden Police Station, Pune, as and when called.
(c) The Applicants shall furnish their cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.
(d) The Applicants shall not directly or indirectly make
any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(e) The Applicants shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
(f) The Applicants shall not leave India without prior permission of the Court.

The Anticipatory Bail Applications are disposed of accordingly.

In view of the disposal of the Anticipatory Bail Application, nothing survives in the Interim Application and the same is also disposed of.
