This is an application for Anticipatory Bail. 2.
The applicant is apprehending his arrest in Crime No. 664 of 2025 registered at Nirmal Nagar Police Station, for the offences punishable under Sections 118(2), 118(1), 115(2), 189(2), 191(2), 190 & 352 of the Bharatiya Nyaya Sanhita, 2023. 3.
According to the prosecution on the date of incident, which took place on 09.09.2025 at around 12.30 a.m., due to previous dispute, the applicant and co-accused started stone pelting on the house of the first informant. It is alleged that when the first informant and his other family members came out of the 1/3
house and requested to stop throwing stones, the applicant and co-accused assaulted them with a steel rod due to which they sustained grievous injuries.

I have heard the learned counsel for the applicant and the learned APP for the respondent-State.

The learned counsel for the applicant submits that there is a cross FIR in relation to the alleged incident. It is submitted that motive for the alleged crime is attributed to the coaccused. It is submitted that there are no criminal antecedents against the present applicant.

On the other hand, the learned APP for the respondentState submits that the present applicant has assaulted the first informant by steel rod. It is further submitted that the custodial interrogation is necessary to recover the said steel rod. Learned APP submits that considering the nature of crime the applicant may not be released on anticipatory bail.

Admittedly there is cross FIR in relation to the alleged incident. The motive for the alleged crime is not attributed to the present applicant. There are no other criminal antecedents against 2/3
the present applicant. In that view of the matter, I am inclined to release the applicant on anticipatory bail. In the result, the following order is passed :
O R D E R
a) The Application is allowed.
b) In the event of arrest of the applicant in connection with Crime No. 664 of 2025 registered at Nirmal Nagar Police Station, for the offences punishable under Sections 118(2), 118(1), 115(2), 189(2), 191(2), 190 & 352 of the Bharatiya Nyaya Sanhita, 2023, the applicant be released on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- with one or two sureties in the like amount.
c) The applicant shall shall not enter into the jurisdiction of Nirmalnagar police station, till conclusion of the trial.
d) The application is disposed of in the aforesaid terms.
