The learned Advocate for the applicant seeks permission to withdraw the present application, with liberty to adopt appropriate proceedings. In view of the fact that, the applicant's application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 is still pending. However, the learned Sessions Judge has not granted interim relief.

Prima facie, the appropriate remedy in such circumstances would be to challenge the refusal by the Sessions Court by way of invoking the judicial review powers of this Court, either through a revision or by filing a Criminal Application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023. 3.

Accordingly, without expressing any opinion on the merits or the entitlement of the applicant, the present application is disposed of as withdrawn, with liberty as prayed for. (AMIT BORKAR, J.)
