This Court on 1st December 2025 passed the following order: "1. Ms. Newton, learned APP submits that the Applicant is not co-operating with the investigation. She submits that even the handset of the Applicant through which photographs of the First Informant has been forwarded to the brother-in-law of the First Informant, has not been handed over.

2. A learned Single Judge by order dated 16th October 2025 has granted interim protection to the Applicant on the condition that the Applicant shall co-operate with the investigation and shall remain present before the Investigating Officer as and when called.

3. Ms. Newton, learned APP, on instructions of the Investigating Officer submits that the Applicant is

not co-operating with the investigation and except on one occasion, he has not attended the Police Station.

4. To give one more opportunity to the Applicant, stand over to 5th December 2025.

5. The Applicant shall attend Taloja Police Station, Navi Mumbai on 4th December 2025 between 11:00 a.m. to 02:00 p.m. and shall co-operate with the investigation.

6. Till next date, ad-interim protection granted by order dated 16th October 2025 shall remain in operation.

7. Ms. Jadhav, learned Counsel appointed to represent the interest of the Respondent No.2 tenders affidavit dated 1st December 2025 of the Respondent No.2, wherein it is stated that the Applicant has threatened the First Informant.

8. The Applicant shall also file affidavit-in-rejoinder to the said affidavit dated 1st December 2025 before the next date."

Ms. Newton, learned APP submits that the Applicant has not complied with the said order and has not attended the Police Station on 4th December 2025 as directed by this Court. 3.

Inspite of ad-interim protection granted by this Court, the Applicant is not co-operating with the investigation and not participating in the investigation.

Mr. Parkar, learned Counsel appearing for the Applicant submits that he has tried to contact the Applicant on several occasions, however, he has also no instructions. 5.

Accordingly, the Anticipatory Bail Application is dismissed as the Applicant is not co-operating with the investigation and he is not available for investigation.

This Court places on record appreciation of assistance rendered by Ms. Pranjal Jadhav, learned Counsel appointed to represent the interest of the Respondent No.2. The High Court Legal Services Committee, Mumbai is requested to pay her professional fees as per rules.
