This application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking pre-arrest bail in connection with C.R. No.150 of 2025 registered with Nanded City Police Station, Pune City, Pune, for the offences punishable under
Sections 123 of the Bharatiya Nyaya Sanhita, 2023 and Section 65(e) of the Maharashtra Prohibition Act, 1949. 3.
As per the prosecution case, the police officers from the Nanded City Police Station, Pune City, Pune received information on 25th July 2025 and accordingly, they found that accused No.1Amol Baburao Gaikwad was in possession of 5 litre illicit liquor worth Rs.400/- at Khadakwasla Bypass Road, Khadakwasla, Pune. During investigation the role of the present Applicant is disclosed as supplier of the said illicit liquor.

It is the submission of Mr. Thobde, learned Counsel appearing for the Applicant that the Applicant was not named in the FIR. The Applicant was not found in the possession of illicit liquor. The Applicant has been arraigned merely on the basis of statement of co-accused and the custodial interrogation of the Applicant is not necessary. He submits that although there is one incident against the Applicant, the Applicant has been granted bail in that case.

Mr. Karmakar, learned APP strongly opposes the Anticipatory Bail Application. He submits that the main role of the Applicant is that he is the supplier of illicit liquor. He submits that the antecedent is also of similar nature and therefore, the Anticipatory Bail Application be dismissed.

Perusal of the record shows that the present Applicant is not named in the FIR. He has been subsequently arraigned on the basis of the statement of co-accused recorded in police custody. Although there is one antecedent, the Applicant has been granted bail in that case.

Accordingly, the case is made out for grant of Anticipatory Bail by imposing conditions. In view thereof, the following order is passed:
O R D E R
(a) In the event of arrest of the Applicant-Prem Jayram Chavan in connection with C.R. No.150 of 2025 registered with the Nanded City Police Station, Pune City, Pune, the Applicant is directed to be released on bail on his furnishing P.R. Bond in the sum of
Rs.50,000/- with one or two solvent sureties in the like amount.
(b) The Applicant shall attend the Nanded City Police Station, Pune City, Pune, on every Sunday between 11:00 a.m. to 01:00 p.m. till filing of the chargesheet and shall cooperate with the investigation. In addition, the Applicant shall attend the concerned Police Station as and when called.
(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.
(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
(f) The Applicant shall not leave India without prior permission of the Court.
