This is an application for Anticipatory Bail. 2.

The applicant is apprehending his arrest in Crime No. 368 of 2025 registered at Boisar Police Station, for the offences punishable under Sections 189(2), 191(2), 190, 118(2), 118(1), 115(2), 352 & 351(2) of the Bharatiya Nyaya Sanhita, 2023. 3.

It is the case of the prosecution that on the date of incident which took place on 23.08.2025 at about 2.00 p.m., the present applicant and other co-accused suspected that the cattle being carried by the first informant and the other injured persons were stolen by them. Upon the said suspicion, the present 1/3

applicant and other co-accused assaulted the the first informant and other injured persons with an iron ord, iron pipe and wooden stick, thereby causing grievous injuries to them. Consequently, the present crime was registered.

I have heard the learned counsel for the applicant and the learned APP for the respondent-State.

The learned counsel for the applicant submits that the applicant has nothing to do with the alleged crime. It is submitted that the FIR was lodged against unknown persons. It is submitted that there are no other criminal antecedents against the applicant. 6.

On the other hand, the learned APP for the respondentState submits that the first informant was brutally assaulted and sustained grievous injuries. It is submitted that the first informant has identified the present applicant as one of the assailants. Learned APP submits that considering the nature of crime the applicant may not be released on anticipatory bail. 7.

I have perused the supplementary statement of the first informant dated 25.08.2025. In the said statement, the first informant identified the present applicant as one of the assailants 2/3

However, it is not stated that the present applicant was armed with some weapon. There are no other criminal antecedents against the applicant. Considering the overall facts and circumstances of the case, I am inclined to release the applicant on anticipatory bail. In the result, the following order is passed :

O R D E R

a) The Application is allowed.

b) In the event of arrest of the applicant in connection with Crime No. 368 of 2025 registered at Boisar Police Station, for the offences punishable under Sections 189(2), 191(2), 190, 118(2), 118(1), 115(2), 352 & 351(2) of the Bharatiya Nyaya Sanhita, 2023, the applicant be released on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- with one or two sureties in the like amount.

c) The applicant shall attend the concerned police station as and when called by the investigating officer and shall co-operate in the investigation.

d.

The applicant shall not tamper with the prosecution evidence.
