By this Anticipatory Bail Application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS"), the Applicant is seeking pre-arrest bail in connection with CR No.227 of 2025 registered with the Swargate Police Station, Pune City, for
the offences punishable under Sections 69, 352 and 115(2) of the Bharatiya Nyaya Sanhita, 2023.

As per the prosecution case, during the period of 20th February 2025 to 22nd February 2025 and on 13th May 2025 the Applicant committed sexual intercourse with the Complainant by implying deceitful means pretending that he would marry her. When the Complainant insisted for marriage, the Applicant assaulted her. With these allegations, the FIR came to be lodged. 4.
It is the main submission of learned Counsel for the Applicant that the FIR is totally false and the Applicant is a married woman even before the said incident took place. 5.
Ms. Yadav, learned APP, strongly opposes the Anticipatory Bail Application. She submits that the offence is very serious and therefore the custodial interrogation is necessary. However, on instructions of the Investigating Officer, she submits that the First Informant is a married lady and the said marriage took place even before the incident took place.

In any case, in the facts and circumstances, no custodial interrogation is necessary. Accordingly, the case is made out for grant of anticipatory bail.

In view thereof, the following Order is passed:
O R D E R
(a) In the event of arrest of the Applicant - Krishna Devidas Ekande in connection with CR No.227 of 2025 registered with the Swargate Police Station, Pune City, he be released on bail on his furnishing PR Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount.
(b) The Applicant shall attend the concerned Police Station on 19th October 2025 between 11:00 am to 02:00 pm and thereafter once in 15 days i.e. on 1st and 3rd Sunday of each month between 11:00 am and 02:00 pm, till filing of the Charge-sheet and shall cooperate with the investigation.
(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and
shall keep the same updated, in case of any change thereto.
(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
