The present application is filed by the applicant seeking protection from arrest under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS). The applicant apprehends arrest in connection with Crime Register No. 66 of 2025 registered with Pali Police Station, for the alleged commission of an offence punishable under Section 103 of the Bharatiya Nyaya Sanhita, 2023 (BNS). The essence of the application is that the applicant fears arrest based on allegations that, on a prima facie view, do not justify custodial interrogation.

The record shows that by order dated 25 September 2025, this Court had already granted temporary relief to the applicant and directed that liberty be reserved for the applicant to approach the Sessions Court for appropriate relief concerning the offence
under Section 103 of the BNS. Acting on such liberty, the applicant approached the Sessions Court by filing an anticipatory bail application. However, the Sessions Court rejected the said application, holding that the nature of the allegations warranted custodial interrogation.

On a careful perusal of the case papers and the earlier order dated 25 September 2025, it is evident that the allegations are not of such gravity as to require immediate arrest. The material collected so far does not disclose any circumstance that would justify depriving the applicant of his liberty at this stage. The investigating machinery has already recorded the relevant statements and collected documentary material. Therefore, continued cooperation of the applicant in the investigation, without arrest, would adequately serve the purpose of justice. 4.
Considering these facts and the reasons already recorded in the earlier order dated 25 September 2025, this Court finds no new circumstance that would warrant departure from the view earlier taken. Hence, following the same reasoning, the applicant deserves protection from arrest. Interim protection is therefore granted, subject to the condition that the applicant shall continue to cooperate with the investigation and shall not misuse the liberty granted by this Court.

Hence, the applicant shall not be arrested in connection with Crime Register No.66 of 2025 registered with Pali police station, for offences punishable under Sections 103 of BNS, the applicant be released on interim bail on furnishing P.R. bond of Rs.25,000/-,
along with one or two sureties in the like amount. a) The applicant shall remain present before the concerned police station as and when called by the investigating officer.
b) The applicant shall not directly or indirectly make any inducement, threat or promise to any witness acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer. c) The applicant shall not obstruct or hamper the police investigation and not to play mischief with the evidence collected or yet to be collected by the police. d) The applicant shall, at the time of execution of the bond, furnish his address and mobile number to the investigating officer, and the Court concerned, and shall not change the residence till the final disposal of the case. 6.
