The present Application is for seeking anticipatory bail. The earlier Anticipatory Bail Application of the Applicant came to be rejected by the Ad-hoc and Additional Sessions Judge, Mumbai vide order dated 16th September 2025 on the ground that Applicant and co-accused concealed themselves and are obstructing investigation.

The learned Advocate for the Applicant submits that the Applicant has no role to play in the alleged conspiracy and that the alleged amount of Rs.1,50,000/- was received in her account from the accused No.5. The learned Advocate referred to page-90 of this Application and submitted that the said amount of Rs.1,50,000/- has been refunded to the Complainant and the same has been 1/3
acknowledged and admitted by the Complainant. The learned Advocate further pointed out that the learned Additional Sessions Judge by his order dated 13th September 2025 passed in Anticipatory Bail Application No.1874/2024 has granted anticipatory bail to original accused No.5. The learned Advocate points out that the learned Additional Sessions Judge has recorded in the aforesaid order dated 13th September 2024 that the Applicant has in fact refunded the entire amount.

Learned A.P.P., on instructions form Mr.Gaikwad, PSI attached to Vinoba Bhave Police Station, Mumbai submitted that the Applicant has co-operated with the Investigating Agency has attended the investigation as and when called upon. 4.
In that view of the matter, the following order is passed:
ORDER

Application is allowed.

In the event of Applicant's arrest in connection with MACR No.5 of 2023 registered with Vinoba Bhave Nagar Police Station for the offences punishable under sections 420, 465, 467, 468, 471, 506 and 120B of the Indian Penal Code, the Applicant shall be released on bail on her executing PR Bond of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one or two sureties in the like sum on following conditions:- a) The Applicant shall attend Vinoba Bhave Nagar Police Station as and when called by the Investigating Officer and shall co-operate in the investigation.

b) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to the police officer.
c) The Applicant shall not tamper with evidence of the prosecution. d) The Applicant shall submit documents regarding her permanent address and contact details to the concerned police station. 5.
Application stands disposed of accordingly.
