Heard Mr. Mishra, learned Counsel appearing for the Applicant and Mr. Karmakar, learned APP appearing for the Respondent-State.

The Applicant is seeking pre-arrest bail in connection with C.R. No.178 of 2025 registered with Kalamboli Police Station, Navi Mumbai, for the offence punishable under Sections 85, 352, 3(5) amd 115(2) of the Bharatiya Nyaya Sanhita, 2023.

As per the prosecution case, the First Informant filed an Application against the Applicant i.e. Husband at Women's Help Desk, Neral, Navi Mumbai and both the parties were called for counseling. As the counseling was not successful, the FIR has been lodged. The marriage between the Applicant and the First Informant took place on 4th May 2018 and in December 2023, the First Informant was assaulted and therefore, she started staying with her father. The FIR has been lodged on 1st August 2025 concerning the harassment of the First Informant for the period from 4th May 2018 to 10th July 2025.

It is the submission of Mr. Mishra, learned Counsel appearing for the Applicant that the FIR is false. He states that the Applicant is ready and willing to cohabit with the First Informant. He submits that in any case, the Applicant will co-operate with the investigation and the custodial interrogation of the Applicant is not necessary. He further states that the Applicant is working in a Cooperative Bank at Lucknow and that there are no antecedents against the Applicant.

On the other hand, Mr. Karmakar, learned APP strongly opposed the Anticipatory Bail Application. He submits that the stridhan is with the Applicant.

In the facts and circumstances, the custodial interrogation of the Applicant is not necessary.

Accordingly, the case is made out for grant of Anticipatory Bail. In view thereof, the following order is passed:

O R D E R

(a) In the event of arrest of the Applicant-Pradeep Ganesh Prasad in connection with C.R. No.178 of 2025 registered with the Kalamboli Police Station, Navi Mumbai, the Applicant is directed to be released on bail on his furnishing P.R. Bond in the sum of Rs.50,000/- with one or two solvent sureties in the like amount.

(b) The Applicant shall attend the Kalamboli Police Station, Navi Mumbai, on 10th November 2025, 11th November 2025 and 12th November 2025 and shall cooperate with the investigation. In addition, the

Applicant shall attend the concerned Police Station as and when called.

(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.

(f) The Applicant shall not leave India without prior permission of the Court.
