Learned APP submits that Applicants have not co-operated with the investigating agency. There is no response to the communication dated 23rd September, 2025 addressed by the Investigating Authority. On 15th September, 2025, Investigating Authority visited the Applicant's native place in Beed District in respect of investigation. Learned APP submit that there is no co-operation from the Applicants. 3.

Upon being asked, whether the Applicants would be willing to deposit the amounts in the Court, which they received from the complainant Sugar Factory, the learned Advocate for the Applicants who 1/2

Mahesh 7-ABA-2961.25.doc were then appearing took time to take instructions and sought a short adjournment. Today, learned Advocate Aniket S. Avhad appearing for the Applicants states that, he has now been instructed to appear for the Applicants and he would be filing his Vakalatnama. Learned Advocate S. R. Kedar, also appearing for the Applicants through V. C., submits that, the Applicants are ready to deposit 25% of the amount. A similar statement was also made on the last occasion i.e. on 24th October, 2025, when time was taken to seek instructions. No amount have been deposited till date. Today, the Applicants have appointed new Lawyer to plead on their behalf. Learned APP submits that, the statement made by the IO on 24th October, 2025 is withdrawn as the Applicants have not co-operated with the investigating agency.
