Heard Mr. Sourabh Ghag learned Counsel appearing for the Applicant and Mr. R.V. Newton learned APP for the State. The Applicant by the present Application filed under Section 482 of the Bhartiya Nyay Sanhita, 2023 is seeking pre-arrest bail in connection with C.R. No.153/2025 registered on 02.05.2025 with Baramati Police Station, Pune Rural under Sections 3(5) and 318 (4) of Bhartiya Nyay Sanhita, 2023.

As per the prosecution case, in or about 2014, the First Informant agreed to purchase 4 acre land from the accused i.e. the Applicant and

his wife for an amount of Rs.40 lakhs. Rs. 10 lakhs were given as advance. As the transactions could not be materialized on 21.06.2018 cheque of Rs.8 lakhs was issued. However, the same was dishonored. By taking these contentions, the crime is registered on 02.05.2025. 3.

It is the main contention of the Mr. Ghag learned Counsel appearing for the Applicant that after a period of about 11 years crime is registered. He states that charge sheet is already filed against the Accused No.2 i.e. Applicant's wife. Thus, investigation is almost completed.

On the other hand, Ms. Newton, learned APP for the Respondent strongly opposed the Application. She submits that even the cheque of Rs.8 lakhs is dishonored.

However, Mr.Ghag learned Counsel states that the said cheque was dishonored in the year 2018 and even thereafter, also the crime is registered after 7 years. He submits that Applicant will completely cooperate with the investigation. 6.

Accordingly, the case is made out for grant of Anticipatory Bail. In view thereof, the following order is passed:

O R D E R

(a) In the event of arrest of the Applicant-Sanjay Uttam

Kharade in connection with C.R. No.153 of 2025 registered with the Baramati, Police Station, Pune (Rural) the Applicant is directed to be released on bail on his furnishing PR Bond in the sum of Rs.1,00,000/- (one lakh rupees) with one or two solvent sureties in the like amount.

(b) The Applicant shall attend the concerned Police Station on every Sunday between 11:00 a.m. to 01:00 p.m.

(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.

(f) The Applicant shall not leave India without prior permission of the Court.
