After the matter was heard for sometime, learned A.P.P. submitted that vide letter dated 10th October 2025, the Investigating Agency has invoked the provisions of the Maharashtra Control of Organised Crime Act, 1999 and, therefore, seeks time to file an affidavit.

Learned Advocate for the Applicant while referring to the letter dated 30th September 2025 addressed by the Applicant to the Investigating Officer along with acknowledgments (page Nos.50 to 53) submitted that the Applicant has already requested the Investigating Officer to check the C.C.Tv footage of Shikin Hotel, Mumbai as it is the case of the Applicant that on the date of incident i.e. 3 rd 1/2

SKN 13-ABA-2980-25.doc September 2025, the Applicant was in Mumbai and not in Pune. The Investigating Officer is directed to verify the said claim of the Applicant. 3.

Let the affidavit be filed on or before 7th November 2025, and copy thereof be served upon the Advocate for the Applicant in advance. 4.

Stand over to 11th November 2025.
