By the present application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("Sanhita"), the Applicant is seeking pre-arrest bail in connection with C.R. No. 707 of 2025 registered with Shirur, Pune Rural Police Station for the offences
punishable under Sections 4 and 25 of the Arms Act, 1959 and Sections 352, 324(4), 3(5), 118(2) and 115(2) of the Sanhita. 3.
The prosecution case is set out in paragraph 8 of the order below Exh. 1, dated 16th October, 2025 passed by the Additional Sessions Judge, Pune in Criminal Bail Application No. 6960 of 2025, which reads as under :

On perusal of copy of FIR, it appears that on the day of incident i.e. on 06/10/2025 the informant, his friend and one Sikandar were proceeding towards agricultural land from front side of house of applicants, at that time applicants stopped their vehicles and applicant No.1 asked Sikandar why he sold his land without informing him and asked him to return his money, else he will implicate him in case of outrage of modesty of woman. It is further alleged that at that time applicant No.1 came near informant with sickle and attempted to assault informant, but informant warded off that blow but he sustained injury on his wrist. There is further allegation that the co-accused assaulted to informant by means iron rod and iron pipe. There is also allegation that applicant No.4 damaged the glasses of car of informant by means of iron rod.
There is allegation that applicant Nos.2 and 3 deleted the videos from the mobile of informant. It appears that the main allegations of assault by dangerous weapon are against applicant No.1. Though there are allegation that applicants No.
there was only injury on the wrist of the informant. The informant has been discharged from hospital. The injury on the wrist of informant is attributed to the applicant No.1. The sickle by which injury to informant is caused is yet to be recovered. 4.
It is the submission of Mr. Icham, Learned Counsel for the Applicant that by order dated 22nd October, 2025, a Learned Single Judge of this Court has already granted ad-interim protection which is in operation till date. He submits that there are no other antecedents. The alleged injury is on the wrist of the first informant and the first informant has been discharged from the hospital even before the order dated 16th October, 2025 passed by the Learned Additional Sessions Judge. He submits that all other accused have been granted anticipatory bail.

On the other hand, Mr. Mangaonkar, Learned APP strongly opposes the application, He submits that as the offence is serious, the anticipatory bail application be dismissed.

Perusal of the record shows that ad-interim relief granted by a Learned Single Judge of this Court by order dated 22nd October, 2025 is in operation till date. The injury is on the wrist of the first informant
and he has already been discharged from the hospital. From the record, it appears that the incident has taken place on a spur of moment and there are no other antecedents.

Accordingly, a case is made out for grant of anticipatory bail. In view thereof, the following order is passed:
O R D E R
a) In the event of arrest of the Applicant, Prakash @ Prakash Bapu Govind Pawar in connection with C.R. No. 707 of 2025 registered with Shirur, Pune Rural Police Station, the Applicant is directed to be released on bail on his furnishing P.R. Bond in the sum of Rs. 25,000/-, with one or two solvent sureties in the like amount.
b) The Applicant shall attend the concerned Police Station on every 10th February, 2026 and 11th February, 2026 between 11:00 a.m. to 02:00 p.m. and thereafter, the Applicant shall attend the concerned Police Station as and when called by the investigating officer and shall cooperate with the investigation. c) The Applicant shall furnish their cell phone numbers
and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.
d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
f) The Applicant shall not leave India without prior permission of the concerned learned Trial Court/Sessions Court.
