This is an application for Anticipatory Bail. 2.

The applicant is apprehending his arrest in Crime No. 724 of 2025 registered at MIDC Police Station, for the offences punishable under Section 306 of the Bharatiya Nyaya Sanhita, 2023.

The applicant was working as an office assistant with Donear Industries Limited, Andheri (East), Mumbai. It is the case of the prosecution that on 03.09.2025 the present applicant stole linen fabric worth Rs.48,000/- from the company premises. Accordingly the present crime came to be registered. 1/3

I have heard the learned counsel for the applicant and the learned APP for the respondent-State.

The learned counsel for the applicant submits that the applicant has nothing to do with the alleged crime. It is submitted that after the registration of the FIR, the applicant was paid bonus. It is submitted that there are no other criminal antecedents against the applicant and the applicant is ready and willing to cooperate in the investigation. 6.

On the other hand, the learned APP for the respondentState submits that the applicant is involved in serious offence of theft. It is submitted that during the course of investigation he was found to have stolen goods worth Rs.13 lakhs. It is submitted that considering the nature of crime, the applicant may not be released on anticipatory bail.

There appears to be delay in lodging the FIR. There are no other criminal antecedents against the applicant. Considering the overall facts and circumstances, I am inclined to release the applicant on anticipatory bail. In the result, the following order is passed :

a) The Application is allowed.

b) In the event of arrest of the applicant in connection with Crime No. 724 of 2025 registered at MIDC Police Station, for the offences punishable under Section 306 of the Bharatiya Nyaya Sanhita, 2023, the applicant be released on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- with one or two sureties in the like amount.

c) The applicant shall attend the concerned police station as and when called by the investigating officer and shall co-operate in the investigation.

d) The applicant shall not commit any other crime.
