The Applicant-Prashant Hari Sarsar in Anticipatory Bail Application No. 2996 of 2025 is accused No. 2 and the Applicant- Sagar
Hari Sarsar in Anticipatory Bail Application No. 2882 of 2025 is accused No. 6 and they are seeking pre-arrest bail in connection with C.R. No. 330 of 2025, registered with Sangvi Police Station for the offences punishable under Sections 103, 189(2), 191(2), 190, 352, 351(2) and 126(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("Sanhita").

The prosecution case is set out in paragraph No. 2 of the order dated 4th October, 2025 passed by Learned Additional Sessions Judge, Pune in Bail Application No. 6005 of 2025, which reads as under :
"2 The incident happened on 22nd July 2025 in the evening at about 6:00 PM to 6:30 PM at the residence of Naveen Dashrath Piwal at Devkar Park, near Reliance Fresh, Pimple- Gurav, Pune. At that time the applicant Prashant Sarsar had called telephonically the informant Ravi Kisan Ghengat and told him to have a meeting to settle the dispute. So, he told him to come at the house of Naveen Piwal along with his son Rameshwar. Therefore, the informant and his son Rameshwar went there. At that time 20 to 22 persons had gathered there outside the house. Firstly, Pratham Akash Solanki alighted from auto rickshaw and at that time Prashant Khokar thought that Akash Solanki might be Rameshwar the son of informant, so he abused him in filthy language and threatened to kill. He also slapped him, at that time the Prashant Sarsar
told Prashant Khokar that he was not Rameshwar and showed the finger towards Rameshwar and said that we will finish him. Thereafter Surendra Hari Sarsar, Karan Vinod Khokar and applicant Prashant 'Sarsar they all assaulted Rameshwar by fist blows and thereby pushed him and took him inside the house of Naveen Pewal. After entering the house the applicant Prashant Sarsar closed the door and he gave a punch on his chest and pushed him down. Thereafter, Rameshwar fell down and Prashant Sarsar gave kick blows on the private part of Rameshwar. At that time Rameshwar started shouting due to pains. The informant and his wife requested Prashant Sarsar but the applicant Prashant Sarsar did not pay heed to them.
Thereafter Surendra Hari Sarsar, Karan Vinod Khokar, Prashant Vinod Khokar, Anjali Sarsar they all assaulted Rameshwar by fist and kick blows on his private part. At that time Sagar Sarsar, Yuvraj Solanki, Sunaina Sarsar, Naveen Pewal they also assaulted Rameshwar by fist and kick blows and on his private part. Thereafter Vinod Papaji Khokar and Prashant Khokar tied Rameshwar by yellow coloured rope and pressed the throat of Rameshwar by that rope. Prashant Khokar took the mobile phone of Vivo company from the pocket of Rameshwar. At that time Akshay Sarsar and Naveen Pewal assaulted Rameshwar on his head and back by belt and they also assaulted him by fist and kick blows. Thereafter, Prashant Sarsar i.e.
the applicant took Rameshwar, informant and his wife Neeta to Sant Tukaram Nagar police station to give the complaint against Rameshwar.
disbursed. Thereafter, Rameshwar was first medically treated on 23rd July 2025 at doctor Riyaz Shaikh Family and Child Clinic Centre as there were pains and his urine NE was blocked. As his pains enhanced he was referred to Sassoon Hospital as per doctors advice. In the night, they all returned back to the house but on 26th July 2025 as there were more severe pains to Rameshwar so in the early morning at 5:00 AM Rameshwar was admitted in Budhrani Hospital, Camp, Pune. There it was revealed that kidney of Rameshwar was damaged and he was advised for dialysis but in the night at 21:30 hours he was declared dead by doctor. So, on 29th August 2025 the informant lodged the FIR."

It is the submission of Mr. Nahar, Learned Counsel appearing for the Applicants that there are total eleven accused in the crime. Out of eleven accused, except the Applicants herein, others have been arrested and released on regular bail. He submits that the charge-sheet is also filed and thus the investigation is complete. He submits that the incident has taken place due to love affair between accused No. 4's daughter and the son of the first informant. He further submits that there was no intention to commit the crime and there are no other antecedents.

On the other hand, Ms. Newton, Learned APP strongly opposes the applications. She submits that the deceased has been assaulted mercilessly, and therefore, anticipatory bail be rejected. 6.
Perusal of the record shows that as there was love affair between accused No. 4's daughter and the son of the first informant, there was some dispute between these two families who are closely related with each other. These two families met together for resolving the dispute, and in that process, some scuffle took place and the family of the accused has mercilessly assaulted the deceased. There are no other antecedents. Out of eleven accused, nine accused have been arrested and released on regular bail. The charge-sheet has been filed against them. Thus, investigation is almost complete even as far as present applicants.

Thus, in the facts and circumstances of this case, case is made out for grant of Anticipatory Bail. In view thereof, the following order is passed:
O R D E R
a) In the event of arrest of the Applicants, namely, the Applicant, Prashant Hari Sarsar in Anticipatory Bail
Application No. 2996 of 2025 and the Applicant, Sagar Hari Sarsar in Anticipatory Bail Application No.2882 of 2025 in connection with C.R. No. 330 of 2025, registered with Sangvi Police Station, the Applicants are directed to be released on bail on their furnishing P.R. Bond in the sum of Rs. 25,000/- each, with one or two solvent sureties in the like amount. b) The Applicants shall attend the concerned Police Station on 11th February, 2026 between 11:00 a.m. to 02:00 p.m. and shall cooperate with the investigation. In addition, the Applicants shall attend the concerned Police Station as and when called by the Investigating Officer.
c) The Applicants shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.
d) The Applicants shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or
to any Police personnel.
e) The Applicants shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.

The captioned Anticipatory Bail Applications are disposed of accordingly.
