The present Application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS") seeking prearrest bail in connection with CR No.838 of 2025 registered with the Yavat Police Station, District-Pune Rural on 28th September 2025 for the offences punishable under Sections 74, 333, 119, 352, 351(2), 351(3) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 ("BNS").

As per the prosecution case, on 21st September 2025 at about 01:00 p.m. the Applicants committed house-trespass, used criminal force on informant with intent to outrage her modesty, snatched mobile phone of her son - Sagar. They wrongfully restrained and intimidated the First Informant and her son. They also intentionally insulted the First Informant and her son. The FIR i.e. CR No.838 of 2025 has been lodged on 28th September 2025 at 9:45 p.m. The FIR has been lodged after delay of 7 days. 4.
Perusal of the record shows that sister of the Applicant No.1 / wife of the Applicant No.2 lodged FIR being CR No.632 of 2025 with Shikrapur Police Station, Pune Rural on 27th September 2025 against Sagar Subhash Thorat, son of the First Informant under Sections 64(1), 64(2)(m), 65(1), 115(2), 351(2) and 351(3) of the BNS and Sections 4, 6, 8 and 12 of the Protection of Children from Sexual Offences Act, 2012. The Applicant Nos.3 and 4 were also close relatives of Applicant No.1. As per the prosecution case in said CR No.632 of 2025, the First Informant i.e. sister of the Applicant No.1/ wife of the Applicant No.2 has been sexually assaulted.

It is the submission of Mr. Paradikar, learned Counsel appearing for the Applicant that the subject FIR i.e. CR No.838 of 2025 has been lodged as a counter-blast to the said FIR i.e. C.R. No.632 of 2025. He submits that totally false FIR has been lodged. He submits that the Applicants have no other antecedents. The Applicants will completely co-operate with the investigation. 6.
Ms. Mulekar, learned APP, strongly opposes the Anticipatory Bail Application.

However, the FIR has been lodged after delay of 7 days. Prima facie, FIR has been lodged as a counter-blast to said FIR No.632 of 2025. Thus, in the facts and circumstances, the case is made out for grant of interim protection.

In view thereof, the following order is passed:
O R D E R
(a) In the event of arrest of the Applicant No.1 - Sachin Sunil Jadhav, Applicant No.2 - Sukhdev Babasaheb Ransing, Applicant No.3 - Nilesh Dipak Darekar and Applicant No.4 - Yogesh Sarjerao Phalke in connection
with CR No.838 of 2025 registered with the Yavat Police Station, Pune Rural, they are directed to be released on bail on each furnishing PR Bond in the sum of Rs.5,000/- with one or two sureties in the like amount.
(b) The Applicants shall attend the concerned Police Station as and when called till filing of the Chargesheet. (c) The Applicants shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
