Heard Mr. Hagare, learned Counsel appearing for the Applicant and Ms. Yadav, learned APP for the State. 2.

By this application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS"), the Applicant is seeking pre-arrest bail in connection with C.R. No.128 of 2025 registered on 7th February 2025, with Yawat Police Station, Pune Rural, for the offences punishable under Sections 333, 74, 76, 115(2), 352, 351(2), 351(3) of the Bharatiya Nyay Sanhita, 2023 ("BNS"). 3.

As per the prosecution case, when the husband of the First Informant was returning home, the Applicant obstructed him and

threatened that he would kill him and abused him. Thereafter at 11.15 a.m., the Applicant and co-Accused entered the house First Informant, having sticks in their hands and started abusing the First Informant and her husband in filthy language and the Applicant beat the husband of the First Informant by fists and kicks. Thereafter when the First Informant tried to intervene, the Applicant caught hold of her shoulder and touched her body part inappropriately and outraged her modesty. On these allegations, the F.IR. has been lodged.

It is the main submission of the learned Counsel appearing for the Applicant that in fact the husband of the First Informant used to harass the Applicant's wife and therefore, the Applicant told the husband of the First Informant to stop said activities and therefore, false F.I.R. has been lodged. He therefore submits that the Applicant be granted anticipatory bail. He submits that the coAccused has been granted anticipatory bail by a learned Single Judge of this Court (Rajesh S. Patil, J.) by Order dated 23rd April 2025 passed in Anticipatory Bail Application No. 995 of 2025. Mr. Hagare, learned Counsel for the Applicant states that the Applicant will completely co-operate with the investigation.

On the other hand, Ms. Yadav, learned APP strongly opposes granting pre-arrest bail to the Applicant. She submits that the First Informant, her husband and mother-in-law have been injured in the incident in question and therefore, custodial interrogation is necessary. Ms. Yadav, also submits that the Applicant is habitual offender and there are two antecedents.

Perusal of Injury Certificate shows that the injuries are simple in nature. They are in the nature of abrasion. As far as antecedents are concerned, they are of the years 2023 and 2024 and in both these cases, the Applicant has been granted anticipatory bail, by this Court.

Accordingly, case is made out for grant of anticipatory bail to the Applicant. Hence, following Order is passed:

O R D E R

(i) In the event of arrest, the Applicant - Revannath Harigiri Gosavi be released on bail in C.R. No.128 of 2025 registered on 7th February 2025, with Yawat Police Station, Pune Rural on executing P.R. bond of

Rs.25,000/- and furnishing one or two sureties in the like amount.

(ii) The Applicant shall attend the concerned Police Station on 10th November 2025 and 11th November 2025 between 11.00 a.m. to 2.00 p.m. and thereafter as and when required by the Investigating Officer. (iii) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(iv) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(v) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant, or any witness, in any manner.

The Anticipatory Bail Application is allowed and disposed of accordingly.
