Heard Mr. Sarda, learned Counsel appearing for the Applicant and Ms. Mulekar, learned APP appearing for the Respondent-State.

This application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking pre-arrest bail in connection with C.R. No.359 of 2025 registered with Wanwadi Police Station, Pune, for the offences punishable under Sections 115(2), 118(1), 3(5) and 352 of the Bharatiya Nyay Sanhita, 2023.

As per the prosecution case, in view of the previous enmity, the accused persons in furtherance of their common intention assaulted the First Informant with hands and as far as the Applicant is concerned, the allegation is that he has assaulted the son of the First Informant on his head with cement block. 4.

It is the main submission of Mr. Sarda, learned Counsel appearing for the Applicant that in fact, there is cross FIR and the Applicant and his father are injured. He submits that the false FIR is lodged. He submits that there are no antecedents against the Applicant and that the Applicant will completely cooperate with the investigation.

Ms. Mulekar, learned APP strongly opposes the Anticipatory Bail Application. She submits that there are eye-witnesses to the incident in question and the son of the First Informant has been assaulted and the Medical Certificate shows that the injuries were moderately severe in nature.

Perusal of the record shows that the even the FIR has also lodged by the accused No.1 bearing C.R. No.365 of 2025 with

Wanwadi Police Station, Pune, on 11th September 2025 for the offences punishable under Sections 352, 3(5), 118(1) and 115(2) of the Bharatiya Nyay Sanhita, 2023. As per the prosecution case, in the said C.R. No.365 of 2025, the First Informant and his family members assaulted the present Applicant and his family members. Perusal of the record shows that the family members of both, the Applicant and the First Informant have sustained injuries. Admittedly, both these families are having enmity. 7.

There are no antecedents against the Applicant. 8.

Accordingly, the case is made out for grant of Anticipatory Bail. In view thereof, the following order is passed:

O R D E R

(a) In the event of arrest of the Applicant-Amar Raju Shinde in connection with C.R. No.359 of 2025 registered with the Wanwadi Police Station, Pune, the Applicant is directed to be released on bail on his furnishing P.R. Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount. (b) The Applicant shall attend the Wanwadi Police

Station, Pune, on 11th November 2025 and 12th November 2025 and thereafter, the Applicant shall attend the Wanwadi Police Station, Pune, once in 15 days i.e. on 1st and 3rd Sunday of each month between 11:00 a.m. to 01:00 p.m. till filing of the chargesheet and shall cooperate with the investigation. In addition, the Applicant shall attend the concerned Police Station as and when called.

(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
