This application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking pre-arrest bail in connection with C.R. No.439 of 2025 registered with Daund Police Station, Pune Rural, Pune, for the offences punishable under Sections 118(1), 119(1), 115(2), 352, 351(2) and 3(5) of the Bharatiya Nyay Sanhita, 2023 and under Sections 39 and 45 of the Maharashtra Money-Lending (Regulation) Act, 2014.

As per the prosecution case, the First Informant has taken some loan from the father of the Applicant and he has not paid the interest and therefore, there is some dispute between the First Informant and the present Applicant. It is the prosecution case that the Applicant has assulted the First Informant with fists and kick blows and also with a stick.

It is the submission of Mr. Kate, learned Counsel appearing for the Applicant that there are no antecedents against the Applicant and the injuries are of simple in nature and therefore, the Anticipatory Bail Application be allowed. 5.
Ms. Newton, learned APP strongly opposes the Anticipatory Bail Application. She submits that in this case, the custodial interrogation of the Applicant is necessary as the Applicant has assulted the injured with a stick.

Perusal of the record shows that the incident in question has taken place as the First Informant has not paid the interest on the loan amount advanced by the father of the present Applicant. As per the prosecution case, the Applicant has assulted the First
Informant with fists and kick blows and with a stick. The injuries are simple in nature.

Accordingly, the case is made out for grant of Anticipatory Bail. In view thereof, the following order is passed:
O R D E R
(a) In the event of arrest of the Applicant-Ritesh Rajesh Jadhav in connection with C.R. No.439 of 2025 registered with the Daund Police Station, Pune Rural, Pune, the Applicant is directed to be released on bail on his furnishing P.R. Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount. (b) The Applicant shall attend the Daund Police Station, Pune Rural, Pune, on Monday and Thursday between 10:00 a.m. to 12:00 noon, till filing of the chargesheet.
(c) The Applicant shall cooperate with the Investigating Officer in conducting investigation.
(d) The Applicant shall furnish his cell phone number and permanent address to the Investigating Officer and
shall keep the same updated, in case of any change thereto.
(e) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(f) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
