Heard Mr. Harshwardhan Pawar, learned Counsel appearing for the Applicant and Ms. G.P. Mulekar, learned APP appearing for the Respondent-State.

This application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS") by the Applicant seeking pre-arrest bail in connection with CR No.327 of 2025 registered on 27th September 2025 with the Fursungi Police Station, District

Pune, for the offences punishable under Sections 108, 115(2), 3(5) 352, 80, 85 of the Bharatiya Nyaya Sanhita, 2023 ("BNS") 3.

As per the prosecution case, the marriage between the deceased and the Accused No.1- Sachin Sanjay Ohol took place on 29th November 2024. The deceased died on 26th September 2025 by suicide i.e. within a period of 10 months from the date of marriage. As per the prosecution case, the Accused were demanding Rs.5,00,000/- from the deceased for construction of house or otherwise asking her to leave the matrimonial house. The Accused were harassing the deceased and insulting her. 4.

It is a main contention of Mr. Harshwardhan Pawar, learned Counsel that the Applicant is a lady of 54 years. She is a cancer surviver and the Accused No.1- Husband is the main Accused who has been arrested. He submits that the Applicant is very poor and working as maid servant.

On the other hand, Ms. Mulekar, learned APP strongly opposes the Anticipatory Bail Application. She submits that in the FIR allegations are made against all the Accused and Applicant has

also played major role in commission of the offence. She submits that as the incident had taken place within a period of 10 months of the marriage there is a presumption against the Applicant. 6.

Perusal of the record shows that the offence is very serious and the Applicant is involved in the crime. The perusal of the record further shows that the Applicant was mentally harassing the deceased and demanding Rs.5,00,000/-. There is incriminating material against the Applicant.

However, the Applicant is a lady and she is a cancer surviver. She is working as maid servant. Accordingly, by imposing certain conditions the Applicant can be granted pre-arrest bail. 8.

In view thereof, the following order is passed:

O R D E R

(a) In the event of arrest of the Applicant - Pushpa Sanjay Ovahal in connection with C.R. No. 327 of 2025 registered on 27th September 2025 with the Fursungi Police Station, District Pune- the Applicant is directed to be released on bail on her furnishing P.R. Bond in

the sum of Rs.10,000/- with one or two solvent sureties in the like amount.

(b) The Applicant shall attend the concerned Police Station on 13th November 2025, 14th November 2025 and 15th November 2025 between 11:00 a.m. to 01:00 p.m. and shall attend the concerned Police Station as and when called till filing of the chargesheet and shall cooperate with the investigation.

(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
