Heard Mr. Dhaygude, learned Counsel appearing for the Applicant and Ms. Mulekar, learned APP for the Respondent-State of Maharashtra.

By the present Anticipatory Bail Application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the Applicant is seeking pre-arrest bail in connection with CR No.549 of 2025 registered with the Yavat Police Station, District-Pune, for the offences punishable under Sections 109, 118(1), 118(2), 115(2), 119(1), 189(2), 191(2), 191(3), 190, 352, 351(2) and

Section 351(3) of the Bharatiya Nyaya Sanhita, 2023 and Sections 4 and 25 of the Arms Act, 1959.

As per the prosecution case, all the Accused on 26th June 2025 at about 01:30 p.m., attempted to murder the Injured - Kailas Hagare by means of sickle, spade and sword. It is alleged that Accused caused injury to the Injured - Kailas on his head by means of sickle. Moreover, Accused have amputated the right hand and left leg of the Injured as well as caused injury on his right leg. Moreover, Accused viz. Pratiksha and Pranjal caught hold and physically assaulted the informant viz. Anushka when she was trying to rescue the Injured.

It is the submission of Mr. Dhaygude, learned Counsel for the Applicant, that the Applicant is a young woman, aged 22 years and she is a student. He submits that the Applicant's role is very limited. The Charge-sheet has already been filed and, therefore, the investigation is completed. He submits that Accused Nos.1, 2, 3 and 4 have been arrested and are still in jail and the Charge-sheet has been filed against them. He therefore submits that, as the

investigation is almost completed, the Anticipatory Bail Application be granted.

On the other hand, Ms. Mulekar, learned APP, strongly opposes the Anticipatory Bail Application. She submits that CCTV footage of the incident shows that the Applicant was found handing over a sword to her brother i.e. Accused No.3 - Pravin Somnath Hagare. She, therefore, submits that the Anticipatory Bail Application be rejected.

Perusal of the record shows that the incident in question occurred due to a boundary dispute concerning agricultural land. 7.

The Applicant is a young lady, aged 24 years. The Applicant is a student. Although some active role is attributed to the present Applicant, as the Charge-sheet has been filed against Accused Nos.1 to 4, the investigation is almost completed. 8.

Mr. Dhaygude, learned Counsel for the Applicant, states that the Applicant will cooperate with the investigation.

Accordingly, by imposing conditions, the Anticipatory Bail Application can be granted.

Thus, case is made out for grant of anticipatory bail. In view thereof, the following Order is passed:

O R D E R

(a) In the event of arrest of the Applicant - Pratiksha Somnath Hagare in connection with CR No.549 of 2025 registered with the Yavat Police Station, DistrictPune, she be released on bail on her furnishing PR Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount.

(b) The Applicant shall attend the concerned Police Station on 20th November 2025 and 21st November 2025 between 11:00 am to 02:00 pm and thereafter as and when called and shall cooperate with the investigation.

(c) The Applicant shall furnish her cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change

thereto.

(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.

(f) The Applicant shall not leave India without prior permission of the Court.
