Heard Mr. Savla, learned Counsel appearing for the Applicant and Ms. Gajre, learned APP for the Respondent-State of Maharashtra.

By the present Anticipatory Bail Application, the Applicant is seeking pre-arrest bail in connection with CR No.75 of 2024 registered on 9th May 2024 with the Koregaon Park Police Station, Pune City, for the offences punishable under Sections 376(2)(n), 366, 354-A, 354-B and 506 of the Indian Penal Code, 1860.

As per the prosecution case, the Victim is a married woman, aged 31 years. The Applicant is Accused No.2. The Accused No.1 is Juber Mohd. Shakir Mansoori. The main allegations under Section 376(2)(n) of the Indian Penal Code, 1860 is against Accused No.1. The only allegation against the present Applicant i.e. Accused No.2 is that he has outraged the modesty of the First Informant. 4.

As far as the prime Accused i.e. Accused No.1 is concerned, he has been earlier granted interim protection by Order dated 21st October 2024 passed by a learned Single Judge in Anticipatory Bail Application No.2818 of 2024 and said Order is confirmed by final Order dated 7th February 2025 passed in said Anticipatory Bail Application No.2818 of 2024.

The Charge-sheet has already been filed against both the Accused. Thus, the investigation is completed. 6.

Accordingly, by imposing conditions, the Anticipatory Bail Application can be granted.

Thus, case is made out for grant of anticipatory bail. In view thereof, the following Order is passed:

O R D E R

(a) In the event of arrest of the Applicant - Moin Khan, in connection with CR No.75 of 2024 registered with the Koregaon Park Police Station, Pune City, he be released on bail on his furnishing PR Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount.

(b) The Applicant shall attend the concerned Police Station as and when called by the Investigating Officer and shall cooperate with the investigation.

(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or

to any Police personnel.

(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
