This is an Application for anticipatory bail. 2.

The Applicant is apprehending her arrest in Crime No.278 of 2025 registered with Rabodi Police Station for the offences punishable under Sections 3(5), 316(2), 316(5), 318(4) of the Bharatiya Nyaya Sanhita, 2023.

It is the case of the prosecution that in the month of January 2025, the first informant had contacted the co-accused Taran Arora for the purpose of purchasing a Mercedes car. Accordingly, the co-accused induced the first informant to pay a sum of Rs.29,69,000/- from January 2025 to March 2025 as advance payment for the said purpose. Subsequently, the co-accused failed to provide the said car as well as did

2 909-ABA 3098-25.doc not refund the said amount to the first informant and defrauded him. The allegations against the present Applicant are that the Applicant has received an amount of Rs.3,50,000/- from the said co-accused. 4.

I have heard Learned Counsel for the Applicant and Learned APP for the Respondent-State.

Learned Counsel for the Applicant submits that the Applicant has nothing to do with the alleged crime. It is submitted that there is no need of custodial interrogation and the Applicant is willing to cooperate with the investigation. It is further submitted that the Applicant, without prejudice to her rights and contentions, is willing to deposit an amount of Rs.3,50,000/-, which according to the prosecution, the Applicant has received from the co-accused.

On the other hand, Learned APP for the Respondent-State submits that the Applicant is involved in a serious crime of cheating. It is further submitted that one more crime of a similar nature is registered against the Applicant.

I have perused the First Information Report. The allegations of cheating are against the co-accused. Considering the overall facts and circumstances of the case, I am inclined to release the Applicant on anticipatory bail. Hence, the following order:-

ORDER

i.

The Anticipatory Bail Application is allowed.

In the event of the arrest of the Applicant in Crime No.278 of 2025 registered with Rabodi Police Station for the offences punishable under Sections 3(5), 316(2), 316(5), 318(4) of the Bharatiya Nyaya Sanhita, 2023, she shall be released on bail on furnishing a PR Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one or two sureties in the like amount.

ii.

The Applicant shall attend the concerned Police Station as and when called for by the investigating officer for further investigation and shall co-operate in the investigation. vi.

The Applicant shall deposit an amount of Rs.3,50,000/- with the Registry of this Court within a period of four weeks from today.

The Anticipatory Bail Application is disposed of in the aforesaid terms.
