Heard Mr. Devkhile, learned Counsel appearing for the Applicants and Ms. Gojre, learned APP appearing for the Respondent-State.

This application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS") seeking pre-arrest bail in connection with C.R. No.315 of 2025 registered on 14th July 2025 with Dighi Police Station, Pimpari Chinchwad District Pune for the offences punishable under Sections 3(5), 316(2) 318(4)

and Section 351(2) of the Bharatiya Nyaya Sanhita, 2023 ("BNSS").

At the outset, Mr. Devkhile, learned Counsel for the Applicants state that he has instructions to withdraw the Anticipatory Bail Application, as far as Applicant No.2 Dhananjay Laxman Karkhanis (Accused No.1) is concerned. He states that as far as the Applicant No.1- Nutan Dhananjay Karkhanis (Accused No.2) is concerned she is a house wife and her role in the crime is very limited. He submits that she has only accompanied the Accused No.1- Dhananjay Laxman Karkhanis when they visited the residence of the First informant. He therefore, submits that the Applicant No.1- Nutan Dhananjay Karkhanis has not actively participated in the crime.

On the other hand, Ms. Gojre, learned APP strongly opposes the Anticipatory Bail Application. She submits that the Applicant No.1- Nutan Dhananjay Karkhanis is not attending the Police Station and not cooperating with the investigation.

Mr. Devkhile, learned Counsel appearing for the Applicant states that Applicant No.1-Nutan Dhananjay Karkhanis will cooperate with the investigation and will attend the Police Station. 6.

Perusal of the record shows that, although, the Applicant has also actively participated in the crime, the Applicant is a house wife of 54 years. Accordingly, by imposing certain conditions Anticipatory Bail can be granted to the Applicant No.1-Nutan Dhananjay Karkhanis.

In view thereof, the following order is passed:

O R D E R

(a) The Anticipatory Bail Application as regards Applicant No.2- Dhananjay Laxman Karkhanis (Accused No.1) is allowed to be withdran and dismissed as such. (b) In the event of arrest of the Applicant No.1- Nutan Dhanjay Karkhanis (Accused No.2) in connection with C.R. No.315 of 2025 registered with the Dighi Police Station, Pimpri Chinchwad District Pune the Applicant is directed to be released on bail on her furnishing P.R.

Bond in the sum of Rs.1,00,000/- with one or two solvent sureties in the like amount.

(c) The Applicant shall attend the concerned Police Station on 17th November 2025, 18th November 2025 and 19th November 2025 between 11:00 a.m. to 02:00 p.m. till filing of the chargesheet and shall cooperate with the investigation. In addition, the Applicant shall attend the concerned Police Station as and when called.

(d) The Applicant shall furnish her cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(e) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(f) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the

Complainant or any witness in any manner.

(g) The Applicant shall not leave India without prior permission of the Court.
