Ms. Simerpreet Singh Chabra, learned Advocate is representing the Applicant. However, none appears for the Applicant.

As the Applicant is seeking Anticipatory Bail, perused the papers with the assistance of Ms. Newton, learned APP. 3.

It is the submission of Ms. Newton, learned APP that Anticipatory Bail be rejected. She relies on the statement recorded of the First Informant under Section 183 of Bharatiya Nagarik

Surakhsha Sanhita, 2023 ("BNSS") where the First Informant has stated that the Applicant has established consensual relationship with many girls by assuring them that he would marry with them. However, Ms. Newton, on instructions submit that there are no antecedents.

As per prosecution case, the First Informant is of 23 years when relationship was started. The prosecution case further shows that the relationship is consensual. Certain WhatApp chats have been annexed to the Anticipatory Bail Application showing that messages sent by the First Informant to the Applicant that her family members are looking suitable boy for her marriage and if, within 2 months no decision is taken regarding marriage, she would marry somebody else.

In any case factual position shows that custodial interrogation is not necessary. However, in the facts and circumstances stringent conditions are required to be imposed. 6.

Accordingly, the case is made out for grant of Anticipatory Bail by imposing stringent conditions.

In view thereof, the following order is passed:

O R D E R

(a) In the event of arrest of the Applicant- Sandeep Sanjay Gaikwad in connection with C.R. No.266 of 2025 registered with the Kothrud Police Station, Pune the Applicant is directed to be released on bail on his furnishing P.R. Bond in the sum of Rs.1,00,000/- with one or two solvent sureties in the like amount. (b) The Applicant shall attend the concerned Police Station on 19th November 2025, 20th November 2025 and 21st November 2025 between 11:00 a.m. to 02:00 p.m. and thereafter once a week i.e. on each Sunday between 11:00 a.m. to 02:00 p.m.

(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade

such a person from disclosing the facts to the Court or to any Police personnel.

(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.

(f) The Applicant shall not leave India without prior permission of the Court.
