Heard Mr. Hrishikesh Ghorpade, learned Counsel appearing for the Applicant and Ms. S.M. Yadav learned APP for Respondent-State. 2.

The Applicant by the present Anticipatory Bail Application filed under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023 is seeking pre-arrest bail in connection with C.R. No.261 of 2025 registered with Ambegaon Police Station, Pune City under Sections 3, 4, 5 of the Immoral Traffic (Prevention) Act, 1956 ("PITA") and Sections 143 and 3(5) of the Bhartiya Nyay Sanhita, 2023, ("BNS"). As per the

prosecution case, the Applicant is the owner of the premises where the prostitution activity was going on.

It is the submission of Mr. Ghorpade, learned Counsel appearing for the Applicant that although the premises in question are of the ownership of the Applicant, the said premises are given on license for a period of sixty months from 1st November, 2021 to 31st October, 2026 by registered leave and license agreement dated 21st September, 2021. He submits that FIR has been lodged on 11th October, 2025 and the Applicant is not concerned with the crime. The Applicant has no antecedents.

On the other hand Ms. Yadav learned APP strongly opposes the Application. She points out last two lines of Paragraph No.22 of the FIR wherein it is stated that the amount received from the customers was being shared even with the owner of the premises. 5.

Perusal of the record shows that except the said allegation that money received from the customers was shared with the owner, there is no other role attributed to the present Applicant. Admittedly, the present Applicant is the owner of the premises in question where it was found that the prostitution activity was going on. However, perusal of

the record further shows that by registered leave and license agreement dated 21st September, 2021, the premises in question has been given for leave and license by the Applicant for a period of 60 months from 21st November, 2021 to 31st October, 2026. There are no antecedents. 6.

The Applicant is Accused No.4. Other accused have been arrested and released on bail.

Accordingly, the case is made out for grant of anticipatory bail. In view thereof, the following Order is passed:

O R D E R

a) In the event of arrest of the Applicant - Mr. Ganesh Dattu More, in connection with CR No.261 of 2025 registered with the Ambegaon Police Station, Pune City, he be released on bail on him furnishing PR Bond in the sum of Rs.1,00,000/- each with one or two solvent sureties each in the like amount. b) The Applicants shall attend the concerned Police Station on 20th November, 2025 and 21st November, 2025, between 11:00 am to 02:00 pm and thereafter once a week till the filing of the chargesheet. c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same

updated, in case of any change thereto.

d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel. e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.

f) The Applicant shall not leave India without prior permission of the Court.
