Heard Mr. Paradkar, learned Counsel appearing for the Applicants and Ms. Yadav, learned APP for the Respondent-State of Maharashtra.

By this Anticipatory Bail Application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS"), the Applicant is seeking pre-arrest bail in connection with CR No.244 of 2025 registered with the Baramati City Police Station, District - Pune, for the offences punishable under Sections 109, 189(2), 191(2), 191(3), 190, 352, 351(2) and 351(3) of the Bharatiya Nyaya Sanhita, 2023. ("BNS")

Mr. Paradkar, learned Counsel for the Applicant states that there are cross FIRs. The only role attributed to the present Applicant No.1- Amol alias Bhairavnath Dhondiram Pawar is that he was present at the time of incident holding stick in his hand and the Applicant No.2- Shobha Bappu Dhotre was having plastic bag containing chilly powder and thrown the same on the face of the injured. He submits that there are no criminal antecedents against the Applicant. He submits that charge-sheet is filed. 4.

Ms. Yadav, learned APP strongly opposes the Application. She submits that the Applicant has played active role and there are grievous injuries on the vital part of injured. 5.

Perusal of the record shows that the charge-sheet is filed and the investigation is completed. There are no antecedents. There is cross- F. I.R. and the First Informant has been arrested and released on regular bail in said cross F.I.R.

Accordingly, the case is made out for grant of anticipatory bail. In view thereof, the following Order is passed:

O R D E R

(a) In the event of arrest of the Applicant Nos. 1) Amol alias Bhairavnath Dhondiram Pawar and 2) Shobha Bappu Dhotre - in connection with CR No.244 of 2025 registered with the Baramati City Police Station, District-Pune, they be released on bail on their furnishing PR Bonds in the sum of Rs.25,000/- each with one or two solvent sureties in the like amount. (b) The Applicants shall attend the concerned Police Station as and when called and shall cooperate with the investigation.

(c) The Applicants shall furnish their cell phone numbers and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(d) The Applicants shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(e) The Applicants shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
